`The nonstatutory double patenting rejection is based on a judicially created doctrine
`
`grounded in public policy (a policy reflected in the statute) so as to prevent the unjustified or improper
`
`timewise extension of the "right to exclude" granted by a patent and to prevent possible harassment by
`
`multiple assignees. A nonstatutory double patenting rejection is appropriate where the conflicting
`
`claims are not identical, but at least one examined application claim is not patentably distinct from the
`
`reference claim(s) because the examined application claim is either anticipated by, or would have been
`
`obvious over, the reference claim(s). See, e.g., In re Berg, 140 F.3d 1428, 46 USPQ2d 1226 (Fed. Cir.
`
`1998); In re Goodman, 11 F.3d 1046, 29 USPQ2d 2010 (Fed. Cir. 1993); In re Langi, 759 F.2d 887, 225

`Claim 1-17 are rejected on the ground of nonstatutory double patenting as being unpatentable
`
`over claim 8 of U.S. Patent No. 9,733,681. Although the claims at issue are not identical, they are not
`
`patentably distinct from each other because '681 does not disclose an impeller cover, however, since
`
`the impeller is already in a housing as disclosed in '681, providing an additional impeller cover would
`
`have been a matter of design choice, and the device of '681 will still function properly with the
`
`modification. The stator being brushless as recited in claim 17 would also have been a matter of design
`
`choice.

`Claim 17 is objected to because of the following informalities: the last sentence of the claims is
`
`incomplete or lacks an period at the end. Appropriate correction is required.

`The examiner has reviewed the document of the AIA Review (IPR 2020-00524) filed on August
`
`24, 2020. None of the prior art references cited in the document (US 20060185830, 5,731,954, and JP
`
`2002-151638) appear to teach nor fairly suggest a heat-exchanging interface having an inner surface
`
`that defines a plurality of channels that direct the flow of the cooling liquid within the thermal exchange
`
`member or an impeller cover as recited.
`

`The prior art made of record and not relied upon is considered pertinent to applicant's
`
`disclosure. The prior art of Eriksen, Lyon, and Wu et al. are pertinent to the Applicant's invention.
`
