`
`REMARKS
`
`Favorable reconsideration of this application, as presently amended and in light of the
`
`following discussion, is respectfully requested.
`
`Claims 6-29 are pending, with claims 6 and 844 amended, and dependent claims 15-29
`
`added, by the present amendment. Claims 6 and 12-14 are independent.
`
`In the Officiai Action, claims 13-14 were objected to; and claims 6-14 were rejected
`
`under 35 U.S.C. § 102(c) as being anticipated by Zhang (US. Patent Pub. No. 200950257408).
`
`Claims 6 and 8-14 are amended to more clearly describe and distinctly claim Applicant’s
`
`invention. Dependent claims 15—29 are added to recite additional features oi“ Applicant’s
`
`invention. Support for this amendment is found in Applicant‘s originally filed specification. No
`
`new matter is added.
`
`Applicant submits the objection to claims 13-14 is moot
`
`in view of the present
`
`amendment.
`
`Briefly reeapitulating, amended claim 6 is directed to
`
`A method for deactivating semi-persistent scheduling (SPS) in a wireless
`mobile communication system, the method comprising:
`
`receiving, by a user equipment (UE), a downlink control channel related to
`a deactivation of the SP8; and
`
`deactivating, by the U13, the SPS after the downlink control channel
`received
`
`is
`
`wherein the deactivation of the SPS includes a release of a downlink
`
`assignment or an uplink grant,
`
`wherein the downlink control channel comprises:
`
`a first binary field related to resource allocation, thefirst binary
`field being entirelyfilled with ‘I ’,

`

`
`In Applicant’s claimed invention, at
`
`least
`
`three specific fields are filled with respectively
`
`predetermined values for SP8 deactivation.

`
`Resource Block (RB) Allocation/Assignment; Modulation and Coding Scheme (MCS); and
`
`Demodulation Reference Symbol (DMRS).
`
`In Zhang’s Fig. 5(1)), the PDCCH can use one reserved or spare bit-field in one ofthe RB

`indicate the TTl bundling configuration and information for PUSCH transmission. The TTI
`
`bundling configuration information can include, but is not limited to, activation/deactivation of
`
`TTI bundling for the WRTU; the number of bundled subframes (when and if applicable); and the
`
`maximum number of hybrid—automatic repeat request (HARQ) re-transmissions.
`
`However, Zheng’s RB allocation field with "0000000000000” is not equivalent
`
`to
`
`Applicant’s second binary field entirely filled with ‘0’ and related to a transmission power
`
`control (TPC), or Applicant’s third binary field entirely filled with ‘0’ and related to a
`
`demodulation reference signal (DMRS).
`
`Indeed, there are no fields in Zhang with any values
`
`equivalent
`
`to Applicant’s claimed second and third binary fields. Accordingly, amended
`
`independent claim 6 patentably defines over Zhang.
`
`Applicant submits that amended independent claims 12-14 patentably define over Zhang
`
`for reasons similar to those presented above relative to amended independent claim 6.
`
`MPEP § 2131 notes that “[a] claim is anticipated only if each and every element as set
`
`forth in the claim is found, either expressly or inherently described,
`
`in a single prior art
`
`reference.” Verdegaaffiros. v. Union 01'! C0. ofCair'fomia, 814 F.2d 628, 631, 2 USPQZL] 1051,
`
`1053 (Fed. Cir. 1987). Because Zhang does not disclose or suggest all of the features recited in
`
`claims 6 and 12-14, Zhang does not anticipate the invention recited in claims 6 and 12-14, and
`
`all claims depending therefrom.
