`the art at the Critical Date (“POSITA”).4 For purposes of this proceeding only,
`
`plain meaning is applied but for the following terms.
`

`tween at least two different uplink signaling formats”
`(Claims 2, 8, 14)
`A POSITA would have understood this limitation to encompass that “the
`
`acknowledgement position indication is selected based on at least two different up-
`
`link message structures and/or bit structures corresponding to different uplink re-
`
`sources.” EX1003, [54]. This is directly derived from the ’179 patent’s definition
`
`of “signaling format5” as “a message structure and/or a bit structure or pat-
`
`tern” (EX1001, 5:47-51), and the ’179 patent’s indication that this claim limitation
`
`includes selection among “uplink signal formats” based on “uplink resources”:
`
`The acknowledgement position indication may be selective
`between two or more different uplink signaling formats. ... For ex-
`ample, for different configured (or scheduled) uplink resources,
`there may be used and/or associated different uplink signaling for-
`mats, for example depending on the size (in time-frequency space,
`e.g. represented by resource elements) of the resource/s.

`trol Information, DCI, message (Claims 4, 10, 16)
`Petitioner does not believe this limitation requires construction given its
`
`plain meaning, but to the extent Patent Owner asserts otherwise, a POSITA would
`
`have understood it to mean “each message representing: (1)a scheduling assign-
`
`ment, (2)a DCI message, or (3)a scheduling assignment and a DCI message.”
`
`EX1003, [55]. This limitation contains “at least one from a group consisting of …
`
`and …,” a classic Markush group listing alternatives. MPEP, §2117.I. “Claim lan-
`
`guage defined by a Markush grouping [that] requires selection from a closed group
`
`‘consisting of’ the alternative members.” Id. Accordingly, this claim phrase is met
`
`by selecting from one or more of the alternatives.
`

`group consisting of transport blocks and code block
`groups” (Claims 5, 11, 17)
`Petitioner does not believe this limitation requires construction given its
`
`plain meaning, but to the extent Patent Owner asserts otherwise, a POSITA would
`
`have understood it to mean “the downlink data elements comprise: (1)transport
`
`blocks, (2)groups of code blocks, or (3)transport blocks and groups of code
`
`blocks.” EX1003, [56]. Similarly, this limitation contains a Markush group.
`
`MPEP, §2117.I. The ’179 patent does not materially distinguish “transport block”

`resource for transmitting the HARQ feedback are selected
`from have one of different associated format for transmis-
`sion of the HARQ feedback and different payload size”
`(Claims 6, 12, 18)
`Consistent with the Specification and prosecution history, this limitation at
`
`least encompasses that “resources of the configured pool of resources, from which
`
`the PUCCH resource for transmitting the HARQ feedback is selected, have differ-
`
`ent associated format for transmission of the HARQ feedback and/or have different
`
`payload size.” EX1003, [57].
`
`For example, the ’179 patent describes that “ARI can point to select between
`
`configured PUCCH resources of different format or payload.” EX1001, 11:41-45.
`
`Further, claims 6, 12, and 18 were added as new claims 16-18 in the Office Action
`
`response of 2019-09-18 and they were alleged to distinguish Seo
`
`(US2016/0270066). EX1002, 55-64. In adding these claims, the Applicant argued
`
`that:
`
`Seo does not describe the claimed “resources of the configured
`pool of resources the PUCCH resource for transmitting the HARO
`feedback is selected from have .. . different associated format for
`

`transmission of the HARO feedback" (emphasis added) as recited in
`Claims 16-18….
`
`Furthermore, there is no description at all in Seo of PUCCH re-
`sources being selected from a pool of resources, where the pool of re-
`sources have a different payload size. Thus, Seo does not describe the
`claimed "resources of the configured pool of resources the PUCCH
`resource for transmitting the HARO feedback is selected from have ...
`different payload size," as recited in Claims 16-18.
`

`II.
`
`’179 PATENT SUMMARY
`A. Description
`The ’179 patent purportedly provides “transmission of uplink control signal-
`
`ing,” particularly “acknowledgement signaling” pertaining to downlink data based
`
`on “acknowledgement position indication provided in downlink control infor-
`
`mation received by the UE [User Equipment].” EX1001, 1:27-28, Abstract. “[T]he
`
`acknowledgment position indication indicates a timing and/or resource for trans-
`
`mitting the acknowledgement signaling.” EX1001, 3: 59-61. “In general, the tim-
`
`ing may be represented by a timing difference or time shift, e.g. between the timing
`
`of reception of the acknowledgement position indication …, and the intended or
`
`scheduled transmitting time structure, e.g., for transmitting the corresponding
`

`acknowledgement signaling.” EX1001, 4:4-10. The acknowledgment position indi-
`
`cation further includes “a resource selection indication like a resource selection pa-
`
`rameter… for example be an ARI (ACK/NACK Resource Indicator).” EX1001,
`
`4:36-44; EX1002, 58-59; EX1003, [42]-[53].
`
`B.
`Summary of the Prosecution History of the ’179 Patent
`The ’179 patent was allowed after claim amendments offered to distinguish
`
`then-applied Seo (US2016/0270066). EX1002, 24, 49, 56-57. The amendments
`
`recited that the acknowledgment position indication includes a timing indication,
`
`that is separate from “the resource selection indication,” and each indication has
`
`“more than one bit.” Id. These features are disclosed in the prior art references
`
`(e.g., Samsung/Kim, Samsung/3GPP, Nokia) advanced by this Petition; none was
`
`before the Examiner during prosecution. EX1003, [48]-[51].
`
`III. THE CHALLENGED CLAIMS ARE UNPATENTABLE
`This request establishes a reasonable likelihood that Petitioner will prevail
`
`on claims 1-18 of the ’179 patent. EX1003, [59]-[336].
`
`A. Ground-1 (Samsung/Kim) & Ground-2 (Samsung/Kim-Fu-
`jitsu)
`1.
`Samsung/Kim (EX1005)
`Samsung/Kim is directed to “transmitting and receiving feedback” by a ter-
`
`minal to a base station in “a pre-5th-generation (5G) or 5G communication system.”
`
`EX1005, Title and Abstract. Samsung/Kim specifies that “feedback information
`

`may refer to information that indicates whether decoding of data transmitted from
`
`the base station is successful or not.” The term “feedback information” is used inter-
`
`changeably with “other terms such as hybrid automatic repeat request (HARQ) in-
`
`formation, HARQ feedback information, and feedback result.” EX1005, [0047];
`
`EX1003, [59].
`
`FIG.3 (annotated below) shows an example feedback procedure between a
`
`base station 310 and a terminal 320. At 335, the base station 310 sends data and
`
`Downlink Control Information (DCI) in a subframe to the terminal. The DCI may
`
`be transmitted through the xPDCCH region of the subframe, and the data may be
`
`transmitted through the xPDSCH region of the same subframe. The DCI indicates
`
`a resource for transmitting feedback information corresponding to the data. At 350,
`
`the terminal 320 transmits HARQ feedback information (e.g., a bitmap) using the
`
`time and frequency resources in a xPUCCH resource indicated by the DCI.

`subframes N, N+1, N+2, etc. Each subframe includes a data element and a corre-

`Each of the DCI includes “HARQ related information” indicating HARQ

`position information and including “time resource information and frequency re-
`
`source information of xPUCCH for transmitting HARQ information, and bitmap
`
`index information.” EX1005, [0149], [0060], [0067]; EX1003, [62]. An example
`
`of this structure is illustrated in FIG.9 (reproduced above), which shows “HARQ
`
`info” that includes “xPUCCH subframe index offset: koffset,” “xPUCCH resource
`
`index: i,” and “Bitmap index.” Id.

`The HARQ feedback information of each subframe can be a bitmap includ-
`
`ing multiple bits, such as “x000” and “xy00” of length B=4 bits, as shown in
`
`FIG.9. EX1005, [0105]-[0107], [0133]; EX1003, [63]. FIGS.8-11 show multiple
`
`examples of how the bitmap is created based on the “HARQ related information”
`
`in the DCI in each of the subframes. EX1005, [0124]-[0145]; EX1003, [63].
`
`Similar to the ’179 patent, Samsung/Kim discloses timing indication (e.g.,
`
`“time resource information”/“xPUCCH subframe index offset: koffset”), separate
`
`from the resource indication (e.g., “frequency resource information”/“xPUCCH re-
`
`source index: i”), and each of which has more than 1 bit. EX1005, [0087]-[0088]
`
`(“The “offset information may be referred to as k_offset. For example, the k_off-
`
`set may be 3-bit information”). EX1005, [0101]-[0103] (The “frequency re-
`
`source information of the xPUCCH may be … an index i indicating the fre-
`
`quency resource,” and “the index i may be 4-bit information” or “2-bit infor-
`
`mation.”); EX1003, [64].
`
`a. Dynamic Drinkware
`SP is incorporated in its entirety in Samsung/Kim. EX1005, [0001]. Thus,
`
`the disclosure of the SP is part of Samsung/Kim and any citation in this Petition to
`
`disclosure of the SP represents citation to disclosure in Samsung/Kim itself. SP
`
`supports at least one of Samsung/Kim’s claims as shown below. EX1003, [66]-
`
`[77]. Accordingly, Samsung/Kim is entitled to SP’s 04/04/2016, filing date. Cisco

`(a) A method by a terminal, the method compris-
`ing:
`SP discloses a method by a UE such as the “Generation of ACK/NACK in-
`
`formation at UE side in HARQ reporting,” and “Operations of UE” slides. EX1006,
`
`6, 8; EX1003, [67].
`
`(b)
`receiving a first subframe from a base station;
`SP discloses “DL grant received in n-th subframe from eNB” (i.e., base sta-
`
`tion) by the UE. EX1006, 8. Page 10’s “Example” shows, upon receiving a first
`
`subframe, e.g., subframe N, the UE will process received downlink subframe N.
`
`EX1006, 10. Accordingly, SP discloses receiving a first subframe from a base sta-
`
`tion. EX1003, [68].
`

`detecting, from the first subframe, downlink
`control information (DCI) including transmis-
`sion timing information and frequency resource
`information for feedback;
`SP discloses that “Operations of UE” include determining “[t]he Koffset value
`
`x contained in DL grant received in n-th subframe from eNB should satisfy the rela-
`
`tion “x>=y-k,” wherein the Koffset value in DL grant is included in DCI transmitted
`
`by the eNB. EX1006, 8; EX1003, [69].

`SP further discloses “HARQ scheduling messages in a DCI” includes “[4] bits
`
`to indicate subframe index offset (Koffset)” and “[2] bits to indicate xPUCCH resource

`index IxPUCCH(i) in which HARQ reporting is transmitted.” EX1006, 5. While the
`
`“subframe index offset (Koffset)” indicates the transmission timing information (e.g.,
`
`the subframe in which the HARQ feedback is transmitted), the “xPUCCH resource
`
`index IxPUCCH(i)” comprises frequency resource information because, to identify an
`
`xPUCCH resource, both “time-axis timing and the frequency-axis index” are
`
`needed and “IxPUCCH(i) is chosen as one of the values in a set “{IxPUCCH(0), IxPUCCH(1),
`
`IxPUCCH(2), IxPUCCH(3)}.” EX1006, 5, 7; EX1003, [70].
`
`Further, Page 10’s “Example” shows that the UE processes the “DL grant @
`
`subframe N,” and transmits “HARQ reporting” based on the “HARQ info” of the
`
`DL grant in DCI that includes “xPUCCH subframe index offset: k” (i.e., transmis-
`
`sion timing information) and “xPUCCH resource index: i,” (i.e., frequency resource
`
`information). EX1006, 10; EX1003, [71]. Accordingly, SP discloses detecting, from
`
`the first subframe N, DCI including transmission timing information and frequency
`
`resource information for feedback. EX1003, [72].

`
`N+Kmin+Koffset = N+3). EX1003, [73]-[74].

`resource index IxPUCCH(i) in which HARQ reporting is transmitted” included in the

`“HARQ scheduling messages in a DCI” (i.e., based on a frequency resource indi-

`(EX1005, Abstract) and Fujitsu provides specific details on subframe structures for

`[79]-[80]. To the extent Patent Owner argues that Samsung/Kim does not disclose
`
`implementation details relating to how many symbols are included in a subframe,
`

`that Fujitsu summarizes existing agreements on this aspect in the 3GPP meetings.
