`I am lead counsel for Petitioner Dell Inc. in IPR2021-00584. I write on behalf of Petitioners to
`respectfully request a conference call with the Board to request the Board’s approval to file a reply
`to Patent Owner’s Preliminary Response in this proceeding.
`
`Specifically, Petitioners request an opportunity to address an unforeseeable claim construction that
`Patent Owner presented and purported to use to establish a different applicable priority date and to
`distinguish prior art. See, e.g., IPR2021-00584, Paper 12 at 15-17, 20-25. Because Patent Owner has
`never previously disclosed this construction in any context and it is a position that is inconsistent
`with the specification and file history, Petitioners could not have foreseen that position and
`therefore request an opportunity to address the proposed construction and its application to the
`applicable priority date and prior art.
`
`Counsel for Patent Owner opposes Petitioners’ request to file a reply to Patent Owner’s Preliminary
`Response.
`
`Please let us know what day and time would be convenient for the Board. Counsel for Petitioners
`and Patent Owner are available on July 13 and 14, between 12 pm and 3 pm ET.
