`The companies that filed this Petition are unrelated entities that each have
`
`separate counsel advising them as it relates to this Petition. For purposes of
`
`efficiency and so as not to burden the PTAB with multiple overlapping petitions
`
`filed by each party identified above, these unrelated entities have joined together to
`

`file, collectively, one single Petition. They have, moreover, agreed that the above
`
`identified “lead counsel” and “back-up counsel” are authorized to speak on behalf
`
`of the group and are the sole attorneys with such authorization (unless revised
`
`mandatory notices are filed designating such a role to a different attorney).

`Many of the companies who filed this Petition have also filed other petitions
`
`involving other patents owned by Patent Owner and have received differing
`
`guidance from the PTAB administrative staff and the panels themselves about each
`
`panels’ preferences about how designations of counsel for multi-party petitions be
`

`
`handled. For example, after filing a number of petitions challenging patents
`
`unrelated to the ’396 patent, the parties to those proceedings received an email
`
`requesting a designation of Lead Counsel for each company listed in those
`
`petitions. The companies filing this Petition attempt to do what the Panel for U.S.
`
`Patent No. 7,319,718 have instructed in designating a single “lead counsel” and a
`

`
`single “back-up counsel” for the entire group of unrelated filers. See Order, Paper
`
`13, Case No. IPR2021-00908.
`
`Importantly, however, in identifying one “lead counsel” for the group, the
`
`parties do not intend to suggest that any of the identified counsel in the above
`
`tables have an attorney-client relationship with all the companies involved, or with
`

`any company other than the company for which they have an executed power of
`
`attorney. Such a suggestion would be both incorrect and would implicate issues
`
`under the ethical obligations of the above listed counsel.
`
`For the avoidance of any doubt, the above designated “Lead Counsel” is the
`
`Lead Counsel pursuant to 37 C.F.R. § 42.10 for this proceeding.
