`
`Pursuant to Local Patent Rule 104.3 and the Court’s Scheduling Order (Dkt. No.
`
`33), Plaintiffs Altria Client Services LLC (“ALCS”) and U.S. Smokeless Tobacco
`
`Company LLC (“UST”) (collectively, “Plaintiffs”) and Defendant R.J. Reynolds Vapor
`
`Company (“Defendant”) (collectively with Plaintiffs, the “Parties” or each individually, a
`
`“Party”) hereby submit their Joint Claim Construction Statement with respect to the
`
`asserted claims of U.S. Patent Nos. 7,798,319, 8,458,996, 8,556,070, 10,143,242,
`
`10,264,824, 10,299,517, 10,485,269, 10,492,541, and 10,588,357.
`
`I.
`
`L.P.R. 104.3 (A) – CONSTRUCTIONS OF CLAIMS, TERMS,
`PHRASES, OR CLAUSES ON WHICH THE PARTIES AGREE.
`
`The parties have met-and-conferred by telephone in an effort to reduce the number
`
`of terms to be construed and to identify, narrow, and focus any areas of dispute. Prior to
`
`their telephonic meet-and-confer, the Parties exchanged email correspondence to identify,
`
`narrow, and focus areas of dispute. The parties have agreed to the following construction:

`The Parties may continue to meet and confer regarding the parties’ claim

`constructions. The Parties also expressly reserve the right to rely on any evidence identified

`by the other Party, and any evidence obtained, or that may be obtained, through claim

`construction discovery. The Parties expressly reserve the right to amend, correct, or
`
`supplement their claim construction positions and supporting or rebuttal evidence in
`
`response to any change of position by the other Party1, in response to information received
`
`during claim construction discovery, or for other good cause.

`II. L.P.R. 104.3(B) – PROPOSED CONSTRUCTIONS OF EACH
`DISPUTED CLAIM TERM, PHRASE, OR CLAUSE, TOGETHER
`WITH AN IDENTIFICATION OF SUPPORTING INTRINSIC AND
`EXTRINSIC EVIDENCE
`
`Plaintiffs’ and Defendant’s proposed construction for each disputed claim term,
`
`phrase, or clause, along with citations to all intrinsic and extrinsic evidence each Party
`
`intends to rely upon is attached as Exhibit A. The Parties agree that where they have cited
`
`to intrinsic evidence (including the specification, figures, and/or file histories) associated
`
`
`1 Defendant notes that, on December 21, 2020, Plaintiffs proposed a construction for
`“tobacco product” and identified certain supporting extrinsic evidence that differed from
`Plaintiffs’ December 11, 2020 Preliminary Proposed Claim Constructions and Extrinsic

`identification of extrinsic evidence to rebut Plaintiffs’ newly proposed construction and

`with any one of the ’319, ’996, or ’070 Patents (“the Bried Patents”), they additionally
`
`intend to rely on the same or similar disclosures associated with the other two Bried Patents.
`
`The Parties similarly agree with respect to the ’517, ’269, ’357, or ’541 Patents (“the Hawes
`
`Patents”) and ’824 or ’242 Patents (“the Weigensberg Patents”).
`
`III. L.P.R. 104.3(C) – THE ANTICIPATED LENGTH OF TIME
`NECESSARY FOR THE CLAIM CONSTRUCTION HEARING
`
`If the Court is to hold a Claim Construction Hearing, Plaintiffs anticipate that a
`
`hearing will take no more than two-and-a-half hours, with Plaintiffs being allocated half of
`
`the time and Defendant being allocated half of the time. Defendant anticipates that four
`
`hours will be needed for the hearing in view of the number of Asserted Patents (nine) and
`
`claim terms in dispute (eleven) and in order to address any questions that the Court may
`
`have regarding the Parties’ claim construction positions and the underlying technology.
`
`Subject to the Court’s preference, the Parties agree to present the disputed claim terms
`
`term-by-term, and for each term the side that proposed the term for construction will
`
`present first, followed by the other side. The Parties further agree that each Party may
`
`reserve time for rebuttal related to each term. The Parties further recognize that the COVID
`
`situation may present unique challenges for the Parties and the Court, and therefore are
`
`amenable to a remote or virtual hearing if the Court prefers and/or if travel restrictions or
`
`other circumstances make an in-person hearing difficult or undesirable.

`IV. L.P.R. 104.3(D) – IDENTIFICATION OF WITNESSES AND
`SUMMARY OF OPINIONS
`
`The Parties do not presently anticipate presenting live witness testimony at the
`
`hearing. The Parties may rely on percipient or expert witness testimony to support their
`
`claim construction briefs consistent with their identification of such testimony as set forth
`
`in Exhibit A, consistent with the deposition testimony these witnesses provide as part of
`
`claim construction discovery in the above-captioned case, and as set forth below.
`
`Plaintiffs intend to present written and/or live expert testimony from Dr. Paul Singh
`
`to respond to and rebut the opinions offered and evidence cited by Dr. John Floros or
`
`Defendant with respect to the term “non-hermetic seal.”2
`
`
`2 Plaintiffs note that on December 11, 2020, Defendant identified the following extrinsic
`evidence to support its proposed construction for “non-hermetic seal”: “Written or live
`expert testimony that the claim term “non-hermetic seal,” read in light of the specification
`and the prosecution history, fails to inform with reasonable certainty, those skilled in the
`art about the scope of the invention.” On the parties’ December 17, 2020 telephonic
`meet-and-confer, Plaintiffs told Defendant that they intend to rely on an expert witness to
`respond to and rebut Defendant’s expert testimony. Plaintiffs confirmed this position in a
`December 22, 2020 email to Defendant. Then, at around 5:00 pm EST on December 22,
`2020 (the day before the deadline to submit this Joint Claim Construction Statement),
`Defendant identified Dr. John Floros as its expert witness and for the first time provided a
`summary of his opinions. These opinions are not sufficiently detailed as required by the
`Local Rules. Accordingly, Plaintiffs specifically reserve the right to supplement the
`summary of Dr. Singh’s opinions and to permit Dr. Singh respond to and rebut any
`argument, opinion, or evidence newly identified in this Joint Claim Construction
`Statement, over the course of claim construction discovery, or as part of Defendant’s
`claim construction submissions. Defendant responds that its expert disclosure, summary,
`and timing thereof fully complied with the Local Rules, and states that Plaintiffs’
`summary of Dr. Singh’s opinions are not sufficiently detailed as required by the Local
`Rules. Defendant likewise reserves the right to supplement the summary of Dr. Floros’s
`opinions and to permit Dr. Floros to respond to and rebut any argument, opinion, or
`evidence newly identified in this Joint Claim Construction Statement or permitted

`As part of this response and rebuttal, Dr. Singh may opine that a person of ordinary
`
`skill in the art in 2008 could determine with reasonable certainty the meaning of the term
`
`“non-hermetic seal” as used in the claims 17 and 25 of the ’319 Patent, claim 1 of the ’996
`
`Patent, and claims 1, 4, 17, 19, and 27 of the ’070 Patent based on the context provided by
`
`the surrounding claim language, the descriptions of the claimed invention provided in the
`
`specifications of the ’319, ’996, and ’070 Patents, and the knowledge of a person of
`
`ordinary skill in the art.
`
`Dr. Singh may further opine that, in light of the surrounding claim language and the
`
`specification of the ’319, ’996, and ’070 Patents, the term “non-hermetic” should be
`
`construed according to its plain and ordinary meaning.
`
`Dr. Singh may modify his opinions, as well as the bases for his opinions, based upon
`
`the nature and content of the information that Defendant or Dr. Floros may produce or
`
`disclose in this matter.
`
`Defendant intends to present written and/or live expert testimony from Dr. John
`
`Floros opining that the claim term “non-hermetic seal,” read in light of the specification
`
`and the prosecution history, fails to inform with reasonable certainty, those skilled in the
`
`art (“POSA”) about the scope of the alleged invention.
`
`In particular, Dr. Floros intends to testify that the term “non-hermetic seal,” as
`
`recited in the claims of the ’319, ’996 and ’070 patents, does not have a defined meaning
`
`
`supplementation thereof, over the course of claim construction discovery, or as part of
`Plaintiffs’ claim construction submissions.

`to a POSA. Although a “hermetic seal” refers to an airtight seal, the term “non-hermetic
`
`seal,” as recited in the claims of the ’319, ’996 and ’070 Patents, cannot refer to any seal
`
`that is not airtight. For example, a seal that allowed a large amount of air to pass would be
`
`contrary to the object of the patents of maintaining the freshness of the stored tobacco.
`
`Dr. Floros also intends to testify that a POSA would have known that a “hermetic
`
`seal” may not necessarily be a perfect seal and may allow some limited amount of air or
`
`gas to pass through. Yet, the patents do not provide any objective criteria for how much
`
`air or gas may pass through the seal for the seal to be deemed a “non-hermetic seal” within
`
`the meaning of the claims.
`
`Accordingly, Dr. Floros intends to opine that the term “non-hermetic seal” as used
`
`in the claims of the ’319, ’996 and ’070 Patents, fails to inform a POSA with reasonable
`
`certainty the scope of the alleged invention.
`
`Dr. Floros may supplement his opinions, as well as the bases for his opinions, based
`
`upon the nature and content of the information that Plaintiffs or Dr. Singh may produce or
`
`disclose in this matter.
