`
`IN THE UNITED STATES DISTRICT COURT
`FOR THE NORTHERN DISTRICT OF TEXAS
`DALLAS DIVISION
`
`HYOSUNG TNS, INC.,
`
`Plaintiff,
`
`v.
`
`Civil Action No. 3:16-CV-00364
`
`DIEBOLD NIXDORF, INC.,
`
`Defendant.
`
`FINAL JUDGMENT
`
`Plaintiff Hyosung TNS, Inc. (“Hyosung”) has asserted U.S. Pat. No. 8,523,235 (“’235
`
`Patent”) against Defendant Diebold Nixdorf, Inc. (“Diebold”) in this action. On July 23, 2020, the
`
`Court issued a Memorandum Opinion and Order addressing claim construction. (Dkt. 102.) In
`
`that order, the Court held that “the phrase ‘cheque standby unit’ is indefinite, and that the ʼ235
`
`patent is invalid for indefiniteness under 35 U.S.C. § 112, para. 2.” (Id. at 11.)
`
`IT IS ORDERED that Claims 1-9 of the ’235 Patent are declared invalid for indefiniteness
`
`under 35 U.S.C. § 112, para. 2.
`
`This is a final judgment, and is appealable.
`
`IT IS SO ORDERED.
`
`SIGNED this 6th day of August, 2020.
