`U.S. PATENT NO. 8,391,298
`
`Pursuant to 37 C.F.R. § 42.8, Petitioner Cisco Systems, Inc. (“Petitioner”)
`
`submits the following updated mandatory notices as required by subsection (b)(2).
`
`Related Matters (37 C.F.R. § 42.8(b))
`
`Petitioner hereby updates its mandatory notices as to judicial or administrative
`
`matters that would affect, or be affected by, a decision in this proceeding as follows:
`
`As noted in the Petition (Paper 2), there are several proceedings (including the
`
`Western District of Texas) that would affect, or be affected by, a decision in this
`
`proceeding. (See generally, Paper 2 at vi-viii). Petitioner specifically identifies the
`
`following proceeding as one that would affect a decision in this proceeding:
`
` Estech Systems, Inc. v. Regions Financial Corporation, WDTX-6-20-cv-
`
`00322 (“Regions Matter”)
`
`In the Regions Matter, Judge Albright held a Markman hearing regarding the
`
`’298 Patent on January 22, 2021. The day before, on January 21, 2021, Judge
`
`Albright issued a preliminary Markman order via email (Ex. 1023). After the
`
`hearing, Judge Albright confirmed via minute entry (Ex. 1024) that the preliminary
`
`constructions were to be adopted. Petitioner notes that the Petition applied the
`
`constructions ultimately adopted by Judge Albright.
