`DEFENDANTS’ PRELIMINARY INVALIDITY CONTENTIONS
`
`Pursuant to the November 30, 2020, Agreed Scheduling Order (Dkt. No. 28), Defendants
`
`Plantronics, Inc. and Polycom, Inc. (collectively, “Defendants”) provide the following preliminary
`
`contentions regarding the invalidity of U.S. Patent Nos. 10,206,025 (“the ’025 Patent”);
`
`10,368,155 (“the ’155 Patent”); 10,469,934 (“the ’934 Patent”); and 10,506,325 (“the ’325
`
`Patent”). Defendants’ Preliminary Invalidity Contentions address the patents and asserted claims
`
`identified in Plaintiff Koss Corporation’s Infringement Contentions of November 6, 2020.
`
`Defendants’ Preliminary Invalidity Contentions reflect their knowledge and contentions as
`
`of this date in the present action. The disclosures are based upon the knowledge, information and/or
`
`belief presently available to Defendants. Defendants’ search for and investigation of prior art is
`
`ongoing, and Defendants reserve the right to modify and supplement their Preliminary Invalidity
`
`Contentions, as permitted by the Agreed Scheduling Order, this Court’s Order Governing
`
`Proceedings, any Court order, and any other applicable rules and statutes, including in the event
`
`that additional prior art is identified during the course of discovery, Defendants’ ongoing
`
`investigation, and/or in response to any permitted amendment by Koss of its Infringement
`
`Contentions. In particular, Defendants reserve their right to serve Final Invalidity Contentions at
`
`the time directed by the Agreed Scheduling Order.

`Each of the asserted claims of the ’025, ’155, ’934, and ’325 Patents is anticipated by and/or
`
`obvious at least in view of the items of prior art identified in Exhibits A-1 to D-8 hereto, alone or
`
`in combination, as set forth in those Exhibits. Much of the prior art identified in the attached
`
`Exhibits reflects common knowledge and the state of the art at the time of filing of the ’025, ’155,
`
`’934, and ’325 Patents. Illustrative examples of anticipation and obviousness, along with examples
`
`of the motivation to combine the selected prior art, are set forth below and in Appendix A.
`
`These contentions should not be taken as an indication of Defendants’ positions regarding
`
`the proper construction of any term. The parties have not yet identified any proposed claim terms
`
`for construction or provided any proposed constructions for such terms. Nor has the Court issued
`
`any claim construction rulings. Defendants’ proposed constructions for disputed claim terms, if
`
`any, will be disclosed at the appropriate time under the Agreed Scheduling Order. Defendants’
`
`contentions do not constitute admissions or adoptions of any particular construction, claim scope,
`
`or plain and ordinary meaning. Rather, Defendants’ contentions may be applicable under a variety
`
`of constructions in order to provide an adequate disclosure in advance of claim construction.
`
`Defendants objects to any attempt by Koss to derive alleged claim construction positions from
`
`these contentions or to otherwise use any of these contentions in claim construction proceedings.
`
`Each of Defendants’ invalidity positions in these preliminary contentions is made in the
`
`alternative to each of Defendants’ other invalidity positions, as well as to each of Defendants’
`
`positions on the noninfringement of the accused products. Nothing in these preliminary
`
`contentions constitutes any concession or admission by Defendants for purposes of validity or
`
`infringement. As a non-limiting example, these preliminary contentions may set forth invalidity
`
`positions that are made in the alternative to Defendants’ noninfringement positions and would
`
`establish the invalidity of the asserted claims in the event that Koss’s incorrect positions on alleged
`
`infringement were adopted. As another non-limiting example, Defendants’ preliminary
`

`contentions may set forth invalidity positions under 35 U.S.C. § 112, ¶ 1, that are made in the

`alternative to Defendants’ invalidity positions under 35 U.S.C. §§ 102 and/or 103.

`To the extent these contentions contain any information that is subject to attorney-client

`privilege or attorney work-product immunity, the disclosure of any protected information in these
`
`contentions is inadvertent and does not constitute a waiver of any such privilege or immunity.

`Defendants contend that the prior art patents and patent application publications listed
`
`below anticipate and/or render obvious the asserted claims of the ’025, ’155, ’934, and ’325 Patents
`
`(collectively, the “Asserted Patents”) under pre-AIA 35 U.S.C. §§ 102(a), (b), and/or (e), and/or
`
`35 U.S.C. § 103, either alone, in combination with any other reference disclosed in these
`
`contentions, and/or in view of the knowledge of a person of ordinary skill in the art. In addition,
`
`Defendants refer to the prior art patents and applications cited in any petition filed before the Patent
`
`Trial and Appeal Board relating to any of the Asserted Patents (or any patent claiming common
`
`priority therewith), including but not limited to IPR2021-00297 and IPR2021-00305, to the extent
`
`they are not listed below. Defendants also contend that these references are evidence of the
`
`background state of the art at the time the asserted claims were allegedly conceived.
