`of my relevant qualifications and professional experience.

`I am currently a Professor in the Department of Library and Information
`
`Science at the Catholic University of America. I have experience working in an
`
`academic library, a medical library, and a legislative library and have been a
`
`professor for more than 25 years. I hold a Ph.D. in Library and Information Studies

`from the University of Wisconsin-Madison and a Masters in Library and Information

`Classification, Organization of Internet Resources, Organization of Information,
`
`Digital Content Creation and Management, Internet Searches and Web Design,
`
`Information Literacy Instruction, Advanced Information Retrieval and Analysis

`Strategies, and The Information Professions in Society. I am familiar with metadata
`
`schema design and implementation. In my teaching I have covered the design and
`
`implementation of metadata in databases, search engines, digital repositories, digital
`
`libraries, and digital archives. I have also covered how information organization
`
`affects the discovery and access to digital resources on the Internet. My research
`
`interests cover cataloging and classification, information organization, metadata,
`
`information retrieval, information architecture, digital collections, scholarly
`
`communication, user interaction with information systems, and others.

`Ex. 1018 is a true and correct copy of an “ET 08.12 Report” entitled
`
`“Advanced Lighting Systems for Externally Lit Billboards” by Design &
`
`Engineering Services, Customer Service Business Unit of Southern California
`
`Edison, published in 2010 by Southern California Edison (“DES”). When I was
`
`asked to prepare this declaration I searched Google for copies and found a metadata
`
`record for DES on the Emerging Technologies Coordination Council (ETCC)
`
`website. Following links in the metadata record I was able to download the full report
`
`and a data file. I understand that the report downloaded from ETCC is being
`
`submitted as Ex. 1018 (“DES”) in this proceeding. The data file is being submitted
`
`as Appendix 1018-E in this declaration.
`
`10. The purposes and membership of ETCC are stated in the “About the
`
`ETCC” webpage (https://www.etcc-ca.com/about-etcc) (Appendix 1018-C) as

`
`Company, San Diego Gas & Electric, and the California Energy Commission
`
`created the Emerging Technologies Coordinating Council (ETCC) to
`
`facilitate collaborations on emerging technologies projects. The ETCC
`
`Leadership Team has grown to include Sacramento Municipal Utility District
`
`and Los Angeles Department of Water and Power. ETCC members are
`
`interested in emerging and underutilized technologies including advanced
`
`lighting, water heating, space heating, and air-conditioning systems, for
`
`residential, commercial, agricultural, and industrial customers.
`
`(Appendix 1018-C at 1.) The About ETCC webpage also states that the ETCC
`
`serves “as a repository for completed project reports from ETCC members: Pacific
`
`Gas and Electric Company, Southern California Edison, Southern California Gas
`
`Company, San Diego Gas & Electric, and the Sacramento Municipal Utility
`
`District.” (Appendix 1018-C at 2.) The information above informs my opinion that
`
`ETCC is an authoritative source for reports by ETCC members, and Ex. 1018, which
`
`I personally located, identified and obtained from ETCC, is an authentic report
`
`completed by Design & Engineering Services of Southern California Edison.

`Lighting Systems for Externally Lit Billboards” as the title, identifies DES as the

`“ET 08.12 Report,” and shows “Design & Engineering Services, Customer Service

`Business Unit, Southern California Edison” as the author. (Ex. 1018 at 1.) This page
`
`also shows a “January 4, 2010” report date and Southern California Edison as the
`
`publisher. (Ex. 1018 at 1.) Page 2 shows the “Acknowledgements” that indicates
`
`“Southern California Edison’s Design & Engineering Services (DES) group is
`
`responsible for this project. It was developed as part of Southern California Edison’s
`
`Emerging Technology program under internal project number “ET 08.12.” (Ex.
`
`1018 at 2.) Page 8 is the Executive Summary that states that “Southern California
`
`Edison’s (SCE) Emerging Technology Program assesses technologies that have the
`
`potential to reduce electric energy use. This report assesses the energy savings
`
`potential and attendant visual impacts of four advanced lighting sources and systems
`
`used to externally light billboards.” (Ex. 1018 at 8.) It also shows the main
`
`objectives of the report are to determine “Available lighting energy savings from the
`
`new and improved systems vs. baseline metal halide systems,” “Light levels and
`
`uniformity provided by the new systems,” “Visual impacts, as determined by a
`
`subjective survey of users of various new systems,” and “Correlation of the
`
`subjective survey results to the objective energy and photometric results.” (Ex. 1018
`
`at 8.) The summary concludes that “[t]he abundance of market-available and cost-
`
`effective … lighting solutions suggests that the California Title 24 lighting power

`density allowance of 2.3 watts per square foot of signage can be reduced to 2.0 W/ft2
`
`or even lower with minimal economic impact on the operators of lighted billboards
`
`in California.” (Id.) DES has a total of 58 pages including five figures, 12 tables,
`
`seven appendices, and references. (See generally Ex. 1018.)
`
`A. ETCC Metadata Record for DES and Availability on ETCC
`Website
`
`12. As a repository of reports by its members, ETCC uses metadata records
`
`to facilitate the searching, discovery, and access to project reports. Appendix 1018-
`
`A is the ETCC webpage for DES that I personally located, identified, and retrieved
`
`from the ETCC website. This is the type of record experts in my field would
`
`reasonably rely on when forming their opinions. The left side of the project report
`
`web page (https://www.etcc-ca.com/reports/advanced-lighting-systems-externally-
`
`lit-billboards) (Appendix 1018-A) is the metadata record. It shows that the project
`
`title is “Advanced Lighting Systems for Externally Lit Billboards,” the project
`
`number is “ET 08.12,” the Investor Owned Utilities is “SCE,” and the project year(s)
`
`is “2008-2010.” (Appendix 1018-A at 1.) It also shows the “End-use” of the report
`
`is “Lighting” for the “Commercial” sector. The metadata record also includes a
`
`project summary that contains the same information as the four project objectives
`
`stated in the Executive summary on page 8 of Exhibit 1018. It also shows the project
`
`includes “1 Report and 1 Data PDF.” The right side of this project webpage shows

`links to download the DES report and the data file. Appendix 1018-E is the data file
`
`(et_08.12_data.pdf) that shows detailed calculations regarding the DES study, as
`
`noted by Reference 12 on page 58 of the DES report (indicating “[t]he financial,
`
`labor and material cost assumptions in this analysis are identical to the lifecycle cost
`
`analysis described in the appendix. See detailed calculations in the ET 08.12 Data
`
`file also attached”).
`
`13. To confirm that DES was available on the ETCC website in 2010, I
`
`found a listing of commercial market reports on the ETCC website including DES
`

`excerpt of the report summary (“This report assesses the energy savings potential
`
`and attendant visual impacts of four advanced lighting sources and systems used to
`
`externally light billboards. . .”). (Id.) The title and excerpted summary in the listing
`
`of commercial market reports on the ETCC website archived on November 5, 2010
`
`(Appendix 1018-B) matches the title and summary found on the metadata record

`report listed in the commercial markets report (Appendix 1018-B) is the same report
`
`as DES. Accordingly, this confirms my understanding that DES was available on the
`
`ETCC website at least as early as its publication date of January 4, 2010 and no later
`
`than November 5, 2010.
`
`B. Actual Usage Record
`
`14. To determine usage of DES, I searched the DuckDuckGo search engine
`
`(https://duckduckgo.com) using the search term “ET 08.12 report” for documents
`
`citing DES, and the search results showed that DES was cited by at least six patents.
`
`I have examined these patents and can confirm that all of them cited DES as
`
`Design & Engineering Services, “Advanced Lighting Systems for Externally
`
`Lit Billboards,” ET 08.12 Report, Southern California Edison, Jan. 4, 2010,
`
`58 pages.
`
`In light of the matching title and other matching descriptive details such as the “ET
`
`08.12 Report” project number and “Jan. 4, 2010” publication date, it is my opinion
`
`these patents all cited the same DES document I discussed above in Section II.A.
`
