`STATEMENT OF RELIEF REQUESTED
`
`
`
`Petitioners AT&T Services, Inc. and DIRECTV, LLC (collectively
`
`“AT&T”) and Patent Owner Broadband iTV, Inc. (“BBiTV” or “Patent Owner”)
`
`have entered into a confidential settlement agreement that resolves all underlying
`
`disputes between AT&T and BBiTV with respect to this inter partes review (IPR)
`
`proceeding and U.S. Patent No. 10,028,026 (“the ’026 Patent”). A copy of the
`
`settlement agreement is being filed with this motion as Exhibit 2300 (the
`
`“Settlement Agreement”). AT&T and BBiTV are concurrently filing a separate
`
`request that the Settlement Agreement be treated as business confidential
`
`information and be kept separate from the files of the involved patent, pursuant to
`
`37 C.F.R. § 42.74(c).
`
`Accordingly, AT&T and BBiTV jointly move the Board to terminate this
`
`IPR proceeding. The Board authorized AT&T and BBiTV to file this joint motion
`

`DISH Network L.L.C. (“DISH”) filed this IPR and jointly filed a motion
`
`with BBiTV to be terminated from this proceeding (Paper 68), which the Board
`
`granted (Paper 72). AT&T was joined in DISH’s IPR.

`AT&T and BBiTV have entered into a confidential Settlement Agreement.
`
`See EX2300 (Confidential). Under the terms of the Settlement Agreement, AT&T
`
`and BBiTV agreed to jointly seek termination of this proceeding.

`A.
`
`Status of All Related Litigations
`
`AT&T and BBiTV are concurrently filing Motions to Terminate the related
`
`pending IPR proceedings IPR2020-01280 (against related U.S. Patent No.
`
`9,998,791) and IPR2020-01359 (against related U.S. Patent No. 9,648,388).2
`
`The Settlement Agreement also requires that AT&T and BBiTV jointly file a
`
`Motion to Dismiss the related pending district court litigation proceedings
`
`involving the ’026 Patent—i.e., case nos. 6:19-cv-712-ADA (W.D. Tex.), 6:19-cv-
`
`714-ADA (W.D. Tex.) (combined with the previous case), and 1:20-cv-717-ADA
`
`(W.D. Tex.).
`
`The ’026 and ’388 Patents are at issue in Broadband iTV, Inc. v.
`
`Amazon.com Services LLC f/k/a Amazon.com Services, Inc. et al., case no. 6:20-cv-
`
`00921 (W.D. Tex.), which remains pending and is unaffected by this settlement.
`
`The ’791 Patent is not at issue in the Amazon case, which in addition to the
`
`’026 and ’388 patents includes three other patents not in dispute between AT&T
`
`
`2 IPR2020-01332 (against related U.S. Patent No. 10,506,269) was
`
`previously terminated. See IPR2020-01332, Paper 37.

` ARGUMENT
`
`37 C.F.R. § 42.72 provides that “[t]he Board may terminate a trial without
`
`rendering a final written decision, where appropriate, including where the trial is
`
`consolidated with another proceeding or pursuant to a joint request under 35
`
`U.S.C. § 317(a).” Termination of the present inter partes review proceeding is in
`
`the interest of justice.
`
`A. The Board should terminate this IPR.
`
`Public policy favors terminating the present inter partes review proceeding.
`
`The federal courts have expressed a strong interest in encouraging settlement in
`
`litigation. See, e.g., Bergh v. Dept. of Trans., 794 F.2d 1575, 1577 (Fed. Cir. 1986)
`
`(“The law favors settlement of cases.”), cert. denied, 479 U.S. 950 (1986). The
`
`Board’s Trial Practice Guide stresses that “[t]here are strong public policy reasons
`
`to favor settlement between the parties to a proceeding.” Office Patent Trial
`
`Practice Guide, 77 Fed. Reg. 48,756, 46,768 (Aug. 14, 2012).
`
`The Board has terminated entire proceedings based on joint motions to
`
`terminate, even after the merits had been fully briefed and oral argument had
`
`occurred. See Apex Med. Corp. v. Resmed Ltd., IPR2013-00512, Paper 39, at 2-3
`
`(P.T.A.B. Sept. 12, 2014) (granting joint motion to terminate after the parties had
`
`
`

`fully briefed the matter because the Board “has not yet decided the merits of this
`
`proceeding, and the record is not yet closed.”); Lam Research Corp. v. Flamm,
`
`IPR2015-01764, Paper 27, at 5 (P.T.A.B. Dec. 15, 2016) (granting motion to
`
`terminate after all briefing and oral argument when statutory deadline for rendering
`
`final written decision is within two months of motion).
`
`Finally, because the Board has not decided the merits of the proceeding, the
`
`expected normal course is to terminate the proceeding upon settlement. 77 Fed.
`
`Reg. at 48,768 (“The Board expects that a proceeding will terminate after the filing
`
`of a settlement agreement, unless the Board has already decided the merits of the
`
`proceeding.”).
`
`B. Written Settlement Agreement
`
`AT&T and BBiTV represent that their entire agreement in connection with
`
`the termination of this proceeding is embodied in the Settlement Agreement, which
`
`has been made in writing. There are no other agreements, oral or written, between
`
`AT&T and BBiTV made in connection with, or in contemplation of, the
`
`termination of this proceeding. The Settlement Agreement has been filed for access
`
`by the “Board and Filing Party Only” due to the highly sensitive business
`
`confidential information it contains, and to ensure that the Settlement Agreement is
`
`not available to other parties previously part of this proceeding who are not parties
`
`to the Settlement Agreement. AT&T and BBiTV desire that the Settlement
`
`

`Agreement be maintained as business confidential information under 35 U.S.C. §
`
`317(b) and 37 C.F.R. § 42.74(c), and a separate joint request for such is being filed

`concurrently.

` CONCLUSION
`
`AT&T and BBiTV respectfully request that the Board grant this Joint
`
`Motion to Terminate this proceeding.
