`Patent Owner, LBT IP I LLC, by counsel, will take the deposition of Petitioner’s
`declarant, Scott Andrews, upon oral examination. In accordance with 37 C.F.R. §
`42.53(d), the parties have conferred and have agreed upon the time and place for the
`abovementioned deposition. The deposition will take place by remote video
`conference, on May 12, 2021 beginning at 11:00 AM Eastern / 8:00 AM Pacific
`time. The deposition will be recorded by stenographic and video means by a court
`reporter licensed to administer oaths. Pursuant to 37 C.F.R. § 42.53(c), the Patent
`Owner deposition time will be limited to 7.0 hours.
`
`The Parties have agreed to one day (7 hours total deposition time) for all five IPRs
`for which identical notices have been filed. In the event of any supplemental
`declaration submitted with the Petitioner Reply, the Parties agreed to a second
`deposition of no more than one day (7 hours total deposition time) for all five IPRs,
`which shall have its own unique deposition notice.
`
`The Parties have agreed that for depositions the witness will be provided clean, hard
`copies of the record in advance of the witness’s deposition. The intended exhibits
`for this deposition are the IPR petitions (including exhibits), the preliminary
`responses thereto, and the decisions instituting trial. The scope and nature of the
`testimony to be elicited will cover the foundation and details of the declarant’s
`declaration, as well as the declarant’s alleged expertise related to the subject matter
`of the IPR petitions.
