`I've unfortunately had to start off before with this group, and

`apologize as profusely as I can for the delay in the trial. I
`
`want to assure everyone on this call I did everything I could
`
`to not postpone this trial, but forces beyond my control have
`
`caused me to delay it. So -- and of course they are all at
`
`heart related to the COVID problem that we're all wrestling
`
`with.
`
`You know, we have some information from other courts now
`
`who have tried to go to trial and they've used different
`

`methods with different levels of success, and my goal of course
`

`
`is to make sure that when we do go to trial this is a very --
`
`12
`
`it's obviously very important to both sides and to the Court,
`
`13
`
`and I want to make sure that we get it done correctly.

`So I know you all have heard this before where I've said
`
`15
`
`I'm going to set the trial for a date that I think will stick.
`

`
`So I'm -- while ultimately I'm going to make the decision what
`
`17
`
`we do, I'm curious to hear from the parties. I have available
`
`18
`
`August 3rd. The -- another case, the Match-Bumble case, has
`
`19
`
`settled and it has freed me up for two weeks in August that I
`
`20
`
`had been planning to do that and so I can easily move this case
`
`21
`
`to that date. However, you know, I'm watching the news this
`
`22
`
`morning. I'm seeing that cases in Texas are on the rise, and I
`

`
`don't -- I'm curious to hear from you all if -- what your
`
`24
`
`thoughts are about going ahead and setting it on August 3rd,
`

`
`which I'm 100 percent in favor of, but I'm a little worried
`

`another problem. I have no reason to think we'll have another
`
`problem right now other than history.

`And so, Mr. Mann, I'll start with you and get your
`
`thoughts and then I'll turn to Mr. Milvenan or Mr. Adams or
`
`whoever's going to speak on behalf of defendants.
`
`Mr. Mann?
`
`MR. MANN: Thank you, Your Honor. And, number one, we
`
`appreciate you -- we know you're working hard to get us -- to
`

`get a trial for both sides. So don't -- you don't obviously
`

`ever need to apologize to us because we know it's not you and
`

`
`we know it's forces beyond your control, but what I would say
`

`
`is I know we're in flux somewhat, but we'd like to have a date
`

`
`set. I don't think we can very well just say, well, we'll set
`
`15
`
`it when we think we can get to it. I kind of anticipated you
`
`16
`
`may say August 3rd and so -- we've not discussed it as a team
`
`17
`
`necessarily, but I think we're going to take the position that
`
`18
`
`when you set this case for trial we're going to be there for
`
`19
`
`trial, and as long -- and I know the Court will work with us if
`
`20
`
`we have a witness or two that may need to appear remotely
`
`21
`
`because of a conflict that came up that wasn't anticipated
`

`because we moved the trial, but we're ready to go and we're
`
`23
`
`going to follow the Court's direction on setting that case for
`

`
`trial on August 3rd. We'd like to go then. I think that would
`

`be a good time for us, and then whatever pretrial date that you
`

`THE COURT: No. No. No. I understand. And I will tell
`
`you, Mr. Mann, you're nice to say that, but I went through a
`
`bit of a depression last week, you know, when all this was --
`
`when I realized that, you know, all the forces that were
`
`happening and, you know, some issues that were coming up and so
`
`I'm very, very disappointed that we won't be going to trial. I
`
`think it's important that we get to trial and, you know, so,
`
`you know, I could go on for awhile, but I won't.
`
`Mr. Milvenan?
`
`MR. MILVENAN: Well, Your Honor, you know, we feel fairly
`

`similar to what Mr. Mann said, you know, about August 3rd we

`could certainly try it then. We are mindful that the Texas
`
`14
`
`Supreme Court, you know, has extended their ban on civil jury
`
`15
`
`trials till August 31st. So, you know, we share your concern
`
`16
`
`that this is potentially a shaky trial date, but, you know,
`
`17
`
`we're certainly, you know, as the Court is, you know, prepared
`
`18
`
`to try it at that time.

`THE COURT: Well, let me say about that. That's a very --
`

`
`you know, we have -- you know, I'm doing -- we're doing our
`

`
`best to keep up with what's going on in the state as well. My
`

`
`understanding that -- I could stand to be corrected -- is I
`

`
`believe that the Supreme Court is all -- State Supreme Court is
`

`
`also allowing jurisdictions to kind of make up their -- if they
`

`
`can show that in their particular geographic area that they are
`

`less affected, you know, say, you know, in Waco rather than

`Austin, for example, I think -- I think the state courts in
`
`Waco, for example, are opening back up. I will tell you all
`
`that I was actually beginning of last week optimistic for your
`
`sake because as I was walking around Waco, people were -- and
`
`maybe this is a bad thing, we'll never know, but, you know,
`
`people were playing basketball, people were playing -- big
`
`groups were playing soccer. There was a large prayer group
`
`right across from the state courthouse of I think maybe 300
`

`people doing a prayer meeting. I don't know exactly which
`

`
`cause they were for, but they were collected. They weren't
`
`12
`
`wearing masks, and to me that was telling me that the people
`
`13
`
`who live in my division, that's sort of where they're at
`

`mentally on this issue. And so I'm -- I would like -- I don't
`
`15
`
`hear any real resistance. I don't have -- and my other -- the
`
`16
`
`other bit of information here, so you know, is this date sort
`
`17
`
`of fell into our hands. I was probably going to try and set it
`
`18
`
`in August anyway and jigger some other things, but if we miss
`
`19
`
`August 3rd, boy, it gets a lot tougher to deal with, other than
`
`20
`
`I'm trying to make some accommodations by inviting some other
`
`21
`
`district judges to come and try other cases in Waco if I were
`
`22
`
`to get too backed up.

`So -- well, I'm going to set this trial for August 3rd.

`Here is the only thing I don't know today. Right now I believe
`

`that that Friday we have a Markman hearing set, and so the

`starting with Mr. Mann. I am thinking of -- yes, sir.

`MR. MANN: No. No. I'm sorry. I was going back to the
`
`trial, but go ahead.

`THE COURT: I'm thinking of seeing if I can move the
`
`Markman off of that Friday so we can go straight through trial.

`My recollection from when I was in trial is I probably would

`have been okay with four really packed days of trial and then a
`

`Friday off and then pick back up Monday, but if -- Mr. Mann,

`I'd like your thoughts on whether you think it'd be better to

`have five days in a row and not have that break or it wouldn't
`

`be better or you don't care. You don't care would be fine for
`

`you to say too.

`MR. MANN: Your Honor, I know there's a lot of theories on

`whether it's -- I mean, three days is nice to wait, but it's
`

`kind of like everything else. If we have two days to get
`

`ready, we'll get ready. If we have three, we'll get ready. So

`we're -- I think we're probably willing to do whatever the

`Court feels the need to do. I mean, appreciate you asking.

`THE COURT: Well, and let me add by suggesting we would go

`Friday, I'm not trying to make it so we get the case to the

`I'm -- this will be my first patent trial and I'm just trying

`to make sure, you know, I do it as well as possible. So -- but

`in my head -- and I'll hear from Mr. Milvenan or whoever from
`
`the defendant in a second -- in my head I guess I'm kind of
`
`agnostic as to what would have been better or worse since my --
`
`my plan is to go pretty solid trial days Monday through
`
`Thursday at least 9:00 to 5:00. And I'll tell you all now, if
`
`I haven't before, I don't like, unless it's unavoidable, to
`

`keep witnesses overnight. And so that might mean on any
`

`
`particular day we might quit a little early rather than start a
`
`12
`
`witness. It also might mean we stay, you know, not a crazy
`

`amount of time because I know you've got to prepare for the
`

`next day, but it might mean that we stay till 5:30 or so if we
`
`15
`
`can to complete a witness so they're not kept overnight.
`

`But, Mr. Milvenan, what is your sense of -- do you care,
`

`
`and if you do, what are your thoughts about me trying to
`

`
`reorganize or reschedule the Markman that is that Friday?

`A question comes to mind in relation to the scheduling

`discussion we're having, and that is, previously Your Honor had

`think we would certainly feel and felt that that was a very

`productive way to go about jury selection and then the
`
`beginning of trial starting on that Monday.

`THE COURT: Yes, sir.

`MR. HADJIS: And if you were going to do that again, at
`
`least the initial reaction to that that we have is that that
`
`would certainly help leave open a Friday if we were in a two
`
`week slot for trial.

`maybe it was too garbled. I definitely intend to do exactly

`that same thing this time as well to select a jury the Thursday

`question about the August 3rd trial schedule that we're

`discussing. This is obviously very new to us and I do not know

`and do not have any reason to believe that Roku the client

`THE COURT: And let me say this as well. That's a great

`question. Because I definitely -- I moved -- I feel great
`
`guilt for having moved this as many times as I have and I know
`
`it's hard to schedule clients who have real lives when you give
`
`them one trial date, and I think I've now had three or four.
`
`Let me say that I would be happy in this situation, though it
`

`may sound a little odd, if for some reason we needed, for
`

`example, to start on a Tuesday, you know, to do things, that'd
`

`be fine. I think, and I'll check on this, I would prefer to

`start on the 3rd, but if for some reason we needed to start on

`the 10th and do the same thing, pick the jury the Thursday or
`

`
`Friday before and start on the 10th, I think I can make that

`work as well. So if that -- I would prefer the 3rd just

`because that means I don't have to move anything I've currently

`got set around, but I think if -- again, just to do everything
`

`I can to accommodate you all, I think if you came back and had
`

`good cause to say that we would all be much better off -- by

`all, I mean, you know, the parties, the lawyers, anyone in

`particular, they'd be better to start off the following Monday,

`let us know hopefully today or so because then I think I

`could -- you know, maybe even if you all tell me you can't be

`there on the 3rd, you know, maybe I'll move something that's

`appreciated. I just wanted to make sure that, you know, we
`
`raised the possibility that there might be some sort of

`impediment on the clients' side before we were able to talk

`with them. Like I said, we have no reason to believe that, but

`we just have not given them this time frame yet.

`getting refreshingly that long ago, that I had clients too.

`So, you know, and so I want to make -- you know, so to the

`extent I can accommodate y'all's schedule, absolutely happy to

`do it. And if this will do it, you know, just let us know

`sooner rather than later so I can start either jiggering my

`schedule or, you know, possibly, you know, asking another

`district judge if they could cover something for me in Waco

`possibilities and I'm happy to do literally anything I can to

`try and, you know, accommodate y'all's schedule, given, you

`know, how cooperative you've been with the Court. So just let

`again, the client I think primarily, if we were to start the

`Thursday. Will that -- again will we defer that till about ten

`days before the trial setting?

`pool, and we were wondering as to whether that would be
