`reside outside the United States. Pursuant to the Board’s order authorizing the
`
`parties to file the joint stipulation (Paper 43), Patent Owner files a copy of the June
`
`30, 2021, telephonic conference transcript between the parties and the Board as a
`
`Paper in this proceeding.

`Your Honor.· Mark Walters for the petitioner.· I'll

`let -- we have attorneys from Sterne Kessler on the

`Your Honor.· This is Jason Fitzsimmons on behalf of

`Mr. Fitzsimmons.· Okay.

`· · · · We scheduled this call to discuss the
`
`parties' request to file a stipulation setting forth
`
`the procedure for petitioner's cross-examination of
`
`patent owner's witnesses in each of IPR2020-01139 and
`
`IPR2020-01142.
`
`· · · · In reviewing the patent owner's motion to
`
`file supplemental information, we understand that
`
`patent owner may be concerned about Mr. Li's ability
`
`to be deposed in China under Chinese law.
`
`· · · · In reviewing petitioner's withdrawal of the
`
`Notice of Remote Deposition of Mr. Orlov, we also
`
`understand that petitioner may be concerned that
`
`Mr. Orlov's deposition would be unlawful under
`
`Russian law.
`
`· · · · We further understand that the stipulation
`
`provides that the cross-examination will be captioned
`
`as an interview instead of a deposition and that the
`
`parties seek that we, the Board, file an order to
`
`endorse the cross-examination.
`
`· · · · Mr. Chad Walters, will you please entertain
`
`whether your desire to file the stipulation stems
`
`

`from a concern that either Mr. Li or Mr. Orlov or
`
`both cannot conduct a deposition under Chinese or
`
`Russian law?
`
`· · · · MR. CHAD WALTERS:· David, do you want to
`
`take this one?
`
`· · · · MR. WILLE:· Yeah.· This is David Wille. I
`
`think I'll respond on behalf of the patent owner.
`
`· · · · So, Your Honor, I would say there is a
`
`concern -- Mr. Li is concerned about giving a
`
`deposition under Chinese law.· And as far as he is
`
`concerned, this procedure would not solve the problem
`
`as to Mr. Li.· He still has a concern about China.
`
`· · · · Mr. Orlov is located in Russia, and
`
`petitioner was concerned about the legality of the
`
`deposition in Russia.· We are not.· We have a Moscow
`
`office, we have defended depositions in Russia
`
`before, and we think the deposition would be legal,
`
`but petitioner has concerns about that.
`
`· · · · And so this is a procedure that's been
`
`adopted in other IPRs where there's concern about the
`
`legality of depositions, for example, in Japan, and
`
`so we offered as a compromise to follow this
`
`procedure so that the cross-examination could occur.
`
`· · · · We also have another witness,
`
`Ms. Kaminskiene, who is in Lithuania.· Again, based
`
`

`upon the advice of our Moscow office, we believe a
`
`deposition there would be legal, but petitioners
`
`have concern that a deposition in Lithuania would
`
`also be illegal.
`
`· · · · And so these procedures would apply to
`
`Mr. Orlov in Russia and Ms. Kaminskiene in Lithuania.
`
`· · · · APJ WOODS:· Thank you, Mr. Wille.
`
`· · · · Now, you'd referenced a prior Board
`
`proceeding.· I assume that's PGR2020-00051; is that
`
`correct?
`
`· · · · MR. WILLE:· Mr. Stavinoha, do you know if
`
`that's correct?· I can't recall the exact number of
`
`that one.
`
`· · · · MR. STAVINOHA:· Yes, that's correct, it's
`
`PGR2020-00051.
`
`· · · · APJ WOODS:· Now, I have reviewed the Board's
`
`order and also the stipulation in that case, and I'm
`
`not sure they are substantially similar; for example,
`
`in that other case there was no stipulation that the
`
`cross-examination be captioned as an interview as
`
`opposed to a deposition.
`
`· · · · Is my understanding correct?
`
`· · · · MR. STAVINOHA:· I believe that's correct,
`
`Your Honor, but we also referenced two IPR
`
`proceedings -- IPR2020-01556 and -01157 -- where the
`
`

`procedure of captioning be proceeding as an interview
`
`rather than as a deposition was used.
`
`· · · · APJ WOODS:· Okay.· And I'm curious.· Did the
`
`Board issue an order endorsing those stipulations in
`
`those two IPRs?
`
`· · · · MR. STAVINOHA:· In those two IPRs I don't
`
`believe there's an order endorsing them.· I believe
`
`the parties were authorized to file them.· But I
`
`believe counsel for petitioner was actually involved
`
`in those cases; so they might be able to give you a
`
`more definitive answer there.
`
`· · · · APJ WOODS:· Okay.· Thank you.
`
`· · · · Mr. Mark Walters, will you please explain
`
`your reasons for requesting a stipulation? I
`
`understand Mr. Wille had explained your concern
`
`regarding the deposition of Mr. Orlov in Russia.
`
`· · · · So your concern -- and please correct me if
`
`I'm wrong -- you're concerned about the legality of
`
`conducting these depositions or interviews in Russia
`
`or China?
`
`· · · · MR. MARK WALTERS:· Yeah.· Thank you,
`
`Your Honor.· Mr. Fitzgibbons [sic] will handle this
`
`for petitioner.
`
`· · · · MR. FITZSIMMONS:· Thank you.· This is
`
`Jason Fitzsimmons.

`· · · · And so the petitioner's concern here is with
`
`respect to Mr. Orlov, who is located in Russia, and
`
`Ms. Kaminskiene, who is located in Lithuania.
`
`· · · · An additional point being that
`
`Ms. Kaminskiene would need a translator, who would be
`
`Mr. Orlov, who would be located in Russia, then
`
`during her interview, cross-examination.· So there's
`
`sort of an interview within an interview issue going
`
`on there.
`
`· · · · But I think the patent owner's summary here
`
`was reasonable.· Those are the concerns.
`
`· · · · Our firm in the past has litigated in Russia
`
`and needed to fly deponents to Belgium, and from some
`
`of the information that petitioner researched, go
`
`through the U.S. Department of State.
`
`· · · · And then through our virtual deposition
`
`cross-examination vendor, Planet Depos, found that
`
`there might be an issue in both Russia and Lithuania.
`
`And so we've worked with patent owner on the joint
`
`stipulation here for the interview procedures,
`
`Your Honors.
`
`· · · · APJ WOODS:· Okay.· And thank you for that
`
`explanation, Mr. Fitzsimmons.
`
`· · · · And are you aware, is it -- are the
`
`witnesses unable to fly to the United States or, in
`
`

`Mr. Li's case, Hong Kong possibly to conduct the
`
`cross-examinations?· Or maybe this question's better
`
`suited for Mr. Wille or Mr. Chad Walters.
`
`· · · · MR. FITZSIMMONS:· We don't know --
`
`petitioner doesn't know.· Patent owner would be in a
`
`better position to provide that information.
`
`· · · · MR. WILLE:· Your Honor, our understanding
`
`from -- with respect to Mr. Li is that, number one,
`
`he's uncomfortable traveling for health reasons, but
`
`number two, there is quarantine requirements both
`
`ways when you travel to Hong Kong and China.
`
`· · · · With respect to the other witnesses, I think
`
`the concern, in addition to various travel
`
`restrictions that are applicable now, there would be
`
`a need to get visas because these are Eastern Bloc
`
`countries, if you will, using maybe outdated
`
`terminology.· So getting the depositions done in the
`
`requisite time, et cetera, is an issue as well.
`
`· · · · APJ WOODS:· Okay.· Thank you, Mr. Wille.
`
`· · · · And just to summarize, so the concerns are
`
`twofold.· One, in Mr. Li's case, has to do with
`
`health and, I assume, related to the COVID pandemic.
`
`· · · · And then as to the other two witnesses,
`
`there's complications or difficulties in getting a
`
`visa.· And so for just maybe practical reasons it
`
`

`would be easier just to conduct these
`
`cross-examinations or witnesses by video conference.
`
`· · · · MR. WILLE:· Yes.· And let me be clear that
`
`Mr. Li still believes he cannot give a deposition
`
`under these procedures, which is why we have
`
`requested the -- we have the motion for supplemental
`
`evidence with another declarant with a second
`
`translation, which is substantially the same as the
`
`first translation.
`
`· · · · APJ WOODS:· Okay.· Thank you, Mr. Wille.
`
`· · · · So, Mr. Wille or Mr. Chad Walters, do you
`
`have anything else to add before I turn it to
`
`Mr. Mark Walters?
`
`· · · · MR. CHAD WALTERS:· No, Your Honor.

`· · · · MR. WILLE:· I don't have anything.

`· · · · APJ WOODS:· Mr. Mark Walters or

`· · · · And, obviously, our preference would be that
`
`the witnesses did come to the United States, as the
`
`Board rules require.· You know, this was obviously
`
`foreseeable when the patent owner was putting forth
`
`these witnesses and their declarations that they
`
`would likely be deposed.· And as the Rules provide,
`

`cross-examination is supposed to occur in the
`
`United States.
`
`· · · · Again, obviously, we are sensitive to the
`
`fact of the global pandemic and potential travel
`
`restraints, but that would obviously be petitioner's
`
`preference.· If they came to the United States, it
`
`would avoid any of these alternative procedures.· And
`
`again, this was a foreseeable circumstance that
`
`patent owner, I guess, neglected to foresee here.
`
`· · · · APJ WOODS:· Okay.· Thank you,
