`Based on its present understanding of the meaning and scope of the claim

`produced discovery in this litigation. UEI therefore reserves the right to amend its

`that its QuickSet 3.0 advantages included volume and power control, including CEC
`
`volume, CEC Power On, CEC Power OFF, and IR. (Id. at 12). UEI described that its
`
`QuickSet software engine “runs as a background process in the host device
`
`(middleware) receiving input from any HDMI/IP control device and sending and
`
`receiving commands to one or more of the available control systems using IR and
`
`CEC.” (Id. at 14).
`
`In 2016, discussions between UEI and Roku included UEI’s device detection
`
`logic technology, which Roku wished to incorporate into its Roku TVs, and complete
`
`integration of QuickSet into Roku’s products to realize universal remote control
`
`capability. (UEI_0052190-005201). Roku aimed to release device detection and
`
`auto-naming of inputs on TVs to market by Spring 2017 and complete integration of
`
`QuickSet’s “ability to control connected devices” by Fall 2017. (Id.). In an attempt to
`
`win Roku’s business, UEI provided documentation and specifications related to its
`
`technology,
`
`including access
`
`to certain software developer kits (“SDKs”).
`

`Specifically, in November 2016, UEI provided Roku access to the QuickSet SDK,
`

`
`including reference documents and SDKs.
`
`
`
`(UEI_0052190-005201).
`
` The
`

`documentation provided included “Control+ Technology in Action” and “Control+
`
`19
`
`Engine with IR and CEC Services.”
`

`The technologies that UEI disclosed to Roku are covered by Asserted Claims of

`the 642, 389, 325, and 853 Patents. Roku, however, decided not to enter into a
`

`
`business deal for UEI’s technology, instead implementing the technology into the
`

`products accused of infringement above, as detailed in the claim charts attached hereto
`

`as Exhibits A through D. No later than 2017, UEI informed Roku in writing that its
`

`QuickSet technology was covered by over 30 patents. (UEI_0052190-005201). To

`the extent Roku did not look into UEI’s patents, after having prior business

`discussions regarding UEI’s technology and incorporating that technology into its

`products, and its infringement of the 642, 389, 325, and 853 Patents continues to date,

`despite the filing of this lawsuit in September 2018.
