`Roku has not yet completed discovery in this case, and UEI’s investigation into
`
`Roku’s infringement is ongoing. These disclosures are therefore based on information
`
`produced by Roku to date regarding the function and operation of the Accused
`
`Instrumentalities (as discussed and defined below), together with UEI’s understanding
`
`of the meaning and scope of the asserted claims and the Court’s claim construction
`
`order. Nothing in these disclosures shall be construed as a waiver to UEI’s right to
`
`seek to amend these disclosures as permitted by law.

`Rule 3-1 Disclosures

`A. Asserted Claims

`Pursuant to the Court’s March 14, 2019 Order (Dkt. 64), and without waiving

`any rights, UEI has limited itself to 25 claims. See Plaintiff Universal Electronics

`
`Literal Infringement or Doctrine of Equivalents
`
`Based on its present understanding of the meaning and scope of the claim
`
`language, and the information currently known to it relating to the Accused
`
`Instrumentalities, UEI asserts that Roku literally infringes, directly and/or indirectly,
`
`each element or step of the Asserted Claims.
`
`To the extent Roku has not literally infringed, directly and/or indirectly, claims
`
`2-3 of the 389 Patent, UEI asserts that it has infringed under the doctrine of
`
`equivalents. Specifically, to the extent Roku’s products do not literally perform the
`
`step “wherein said codeset is identified when said user stops pressing a key on said
`
`remote control device,” this limitation is performed under the doctrine of equivalents.
`
`In Roku’s products, a codeset is identified during the initial and remote setup options
`
`via a user pressing the up and down arrow keys and the “OK” key to respond to on-
`
`screen prompts. This performs substantially the same function as the limitation of
`
