`
`them set up a little differently.
` I'm going to move to U.S. patent number
`7,200,855. I'm going to reference that as the
`'855 patent. We're adopting the parties' agreed
`upon constructions as of the October 28th joint
`claim construction chart. Okay. Under the '855
`patent the first term on construing is a shared
`box, and what we are actually adopting is
`something of a hybrid between what Rovi's proposed
`construction was and what Comcast's proposed
`construction was.
` And this is the definition, and I'll
`state it fairly slowly. A box, located within a
`multi media server, that is shared by components
`of that multi media service. So we're not
`adopting either party's construction, but are
`giving you a slightly different construction which
`limits or narrows Rovi's proposed construction to
`just a -- from a plurality of devices and that
`narrows essentially also or explains more clearly
`Comcast's and adds to Comcast's construction.
` So again let me repeat that. A box
`
`16 (61 to 64)
`

`
` JUDGE MCNAMARA: Sure, of course.
`Determining -- and you'll see the exact
`grammatical change or the grammar in how it's used
`here and the punctuation. Determining that a data
`{frame/packet} at one of the specific time
`intervals contains at least a portion of one of
`the plurality of channel selection
`{commands/requests} without recapturing be at
`least a portion of one of the plurality of channel
`selection {commands/requests} via decoding.
` MR. RAMANI: Thank you, Your Honor.
` JUDGE MCNAMARA: Okay. And I think the
`Markman order should be up on EDIS probably by
`Friday and if not certainly by Monday. Going back
`to the patent, the '528 patent, the interactive
`television program guide is the next claim
`construction.
` The construction that we are adopting
`is an application that generates a display of
`television program listings or user television
`equipment and that allows users to navigate
`through and interact with television program
`
`62
`
`located within a multi media server, that is
`shared by components of that multi media server.
`The next term that I am construing is identifying
`a data {frame/packet}, and frame/packet are in
`brackets, and there's a forward slash between
`frame and packet, at one of the specific time
`intervals that contains at least a portion of one
`of the plurality of channel selection
`{commands/requests}, and again the words commands
`and requests are in brackets.
` The -- what we are adopting here is the
`definition as follows: Quote, determining
`{E/ING}, that a data {frame/packet} at one of the
`specific time intervals contains at least a
`portion of one of the plurality of channel
`selection {commands/requests} without recapturing
`be at least a portion of one of the plurality of
`channel selection {commands/requests} via
`decoding. Does anybody need me to repeat that?
` MR. RAMANI: Yes, Your Honor. This is
`Ashok Ramani. Would you mind repeating it,
`please?
`
`64
`listings based on user commands. So essentially
`that is Rovi's proposed construction, and this is
`similar to the 1103 so there should not be --
`there should not be any confusion about this.
` The next claim construction is personal
`video recorder compliant device, and the
`construction that's being adopted here is a device
`that provides personal video recorder, and then in
`quotes PVR -- of course that's the acronym for
`personal video recorder -- functionality only when
`0
`coupled to a PVR, and that's the definition.
`11
` Let me repeat that. Device that
`12
`provides personal video recorder -- its acronym is
`13
`PVR -- functionality only when coupled to a PVR,
`14
`so that is the definition of that. So I think
`15
`other than distinctly -- I think we've covered all
`16
`of the 10 terms that were construed for Markman.
`17
` Did I miss anything? I think I got
`18
`them all.
`19
` MR. KAMPRATH: Your Honor, I think
`20
`there's one other for the '528. It's the personal
`21
`video recorder extensions term.
