`Patent Owner respectfully requests mandatory conference call with the Board regarding a Response by Patent Owner
`and a contingent Motion to Amend:

`1. Patent Owner intends to file Patent Owner's Response under C.F.R. § 42.120
`
`1. In response to the Board's denial of Patent Owner's Request for Rehearing, Patent Owner intends
`to rely in part on Exhibits 2025-2027 and arguments made in Request for Rehearing, as well as
`additional arguments.
`
`2. Patent Owner also intends to amend one or more claims under C.F.R. § 42.121

`1. For example, Claim 1 may be amended so that the '523 patent's priority date will be the filing date
`of '394 Provisional, i.e., May 25, 2007. The amendment to Claim 1 will be a contingent substitute Claim
`1.

`3. Patent Owner also intends to request preliminary guidance from the Board concerning his Motion to
`Amend, in accordance with the New Pilot Program Concerning Motion to Amend Practice.
`
`Petitioner does not believe a call is necessary, but to the extent the Board would like to have a call, Patent Owner and
`Petitioner are available for a call with the Board each day next week aer 3pm EST.
