`Honorable Board:
`
`On July 22, 2020, the Board issued its decision invalidating claim 17 of the
`
`’079 patent in IPR2019-00510. The deadline for filing a notice of appeal of this
`
`decision was September 23, 2020 (which is 63 days after July 22, 2020, per 37 C.F.R.
`
`§ 90.3(a)(1)). Patent Owner did not file a Notice of Appeal.
`
`On September 25, 2020, Petitioner contacted Patent Owner’s counsel
`
`requesting confirmation that Patent Owner had no intention of seeking an appeal of
`
`the Board’s decision in IPR2019-00510. Patent Owner responded to Petitioner
`
`confirming the same, and on October 2, 2020, Patent Owner informed Petitioner that
`
`it would agree to join a motion to terminate this proceeding. The parties have filed
`
`a joint motion to terminate this proceeding on even date herewith. Nevertheless, in
`
`the event the Board in its discretion denies this Motion to Terminate, the parties have
`
`conferred and reached agreement regarding modification of the portion of DUE
`
`DATE 2 related to Petitioner’s Reply to Patent Owner’s Response to Petition and
`
`the portion of DUE DATE 3 related to Patent Owner’s sur-reply. The parties hereby
`
`stipulate to the following adjustments to the schedule in the event the joint motion
`
`to terminate is denied:
