`Patent Owner (Miller) requests authorization to file a five-page motion requesting the Board to cede exclusive
`jurisdiction in this matter for the correction of an alleged defect in the chain of priority of the ‘188 Patent raised by
`Petitioner (Guardian). Petitioner does not oppose the request for authorization, but desires to oppose the
`motion. Patent Owner does not oppose Petitioner filing an opposition up to five pages.

`Second, Petitioner requests authorization to file a motion to admit Evan Talley pro hac vice as back-up counsel. Patent
`Owner does not oppose the request and does not expect to oppose the admission of Mr. Talley as back-up counsel.

`Should the Board desire a conference call to discuss the matter, counsel for the parties are available at 1-5 PM Eastern
`time on 10/31, 11/4, or 11/5.
