`Notice is hereby given that Plaintiffs Ethanol Boosting Systems, LLC and Massachusetts

`Institute of Technology, in the above-captioned case, hereby appeal to the United States Court of
`
`Appeals for the Federal Circuit from the final judgment entered in this action on February 11,
`
`2020 (D.I. 144) (the “Final Judgment”); the February 11, 2020 Joint Stipulation of Non-
`
`Infringement (D.I. 142); the January 28, 2020 Claim Construction Order (D.I. 140); the January
`
`8, 2020 Markman Hearing (the “Markman Hearing”); and any and all of the decisions and
`
`findings of this Court underlying and leading to any of the foregoing. This Notice of Appeal is
`
`filed within 30 days of the entry of the Final Judgment and is therefore timely under Federal
`
`Rule of Appellate Procedure 4(a).
`
`Enclosed herewith is the $505 fee required by 28 U.S.C. §§ 1913, 1917.
