`I, Bijal Vakil, declare as follows:

`I am a member in good standing of the California State Bar as well as

`the following Federal Courts: U.S. Court of Appeals for the Federal Circuit, U.S.

`Court of Appeals for the Ninth Circuit, U.S. District Courts for the Central,

`Eastern, Northern and Southern Districts of California, U.S. District for the Eastern

`District of Texas, U.S. District Court for the District of New Mexico and the U.S.

`I am experienced with the subject matter of U.S. Patent No. 9,016,566

`(the “’566 patent”) at issue in this proceeding, including its prosecution history and
`
`the scientific field to which the ’566 patent relates. I advised Petitioner regarding
`
`the present IPR proceeding, through which I have developed a thorough
`
`understanding of the ’566 patent, the relevant art, and the scientific field.

`I am an experienced litigating attorney with over 23 years in private
`
`practice in the U.S. During this time, I have gained experience representing clients
`
`at trial, in summary judgment proceedings, and in appeals. I have substantial
`
`experience with patent litigation, having served as counsel in complex patent
`
`litigation matters, participated

`in Markman hearings, summary
`
`judgement
`
`proceedings, and other patent-related pleadings and hearings concerning patent
`
`invalidity and infringement issues.
