`I, Melanie Arlantico, declare:

`I am employed at the law firm of Freitas & Weinberg LLP, counsel
`
`for Patent Owner Aquila Innovations Inc. in the above-captioned proceeding. I
`
`have person knowledge of the facts in this declaration.
`
`2.

`I reside in the San Francisco Bay Area, which I understand remains
`
`under stay-at-home orders due to the COVID-19 pandemic. The stay at home
`
`orders require everyone employed at the firm, who ordinarily do not work from
`
`home, to work remotely.
`
`3.
`
`I use remote desktop software to access my work desktop computer
`
`that is physically located at the firm’s Redwood Shores, California offices.
`
`Counsel’s work product, including all of the electronic files related to Aquila’s
`
`Patent Owner Response, is stored on devices other than my home computer.
`
`4.
`
`On June 5, 2020, beginning at 10:45 PM Eastern time, I prepared
`
`Aquila’s Patent Owner Response and corresponding exhibits for filing using a
`
`remote connection to my work desktop computer. Beginning around 11:35 PM and
`
`ending around 11:45 PM Eastern time, while the Patent Owner Response was
`
`processing, I successfully filed Exhibits 2005 to 2014.
`
`5.
`
`After filing the exhibits, the remote desktop software crashed while I
`
`was finalizing the Patent Owner Response for filing, cutting off my access to my
`
`work desktop computer and the Patent Owner Response. Despite my best efforts, I
`

`was not able to reconnect with my work desktop computer until 12:16 AM Eastern
`
`time on June 6, 2020, 16 minutes after the deadline.
`
`6.
`
`Had the remote desktop software not crashed, I would have been able
`
`to file the Patent Owner Response before midnight.
`
`I declare under penalty of perjury that the foregoing is true and correct to the
`
`best of my knowledge. Executed in San Mateo, California.
