`Petitioners Nokia Corp. and Nokia of America Corp. (collectively, “Nokia”
`
`or “Petitioners”) request a refund of post-institution fees in the amount of $15,000.
`
`On July 1, 2019, Petitioners filed a Petition for Inter Partes Review of U.S.
`
`Patent No. 6,771,646. As required by 37 C.F.R. § 42.15(a), Petitioners deposited
`
`$30,500 with the U.S. Patent and Trademark Office (“USPTO”) at the time of
`
`filing the Petition to cover associated fees. Petitioners’ payment consisted of
`
`$15,500 in fees associated with the request for Inter Partes Review, and a further
`
`$15,000 in post-institution fees.
`
`On September 25, 2019, the Parties filed a Joint Motion by Petitioners and
`
`Patent Owner to Terminate Proceeding (Paper No. 7) based on a Confidential
`
`Settlement Agreement (Ex. 1069) that resolved all of the disputes between the
`
`parties concerning the Challenged Patent. As of that date the Board had not yet
`
`rendered an institution decision. On September 26, 2019, the Board granted the
`
`parties’ Motion (Paper No. 9). Inter Partes Review was thus not instituted.
`
`Accordingly, Petitioner requests a refund of the post-institution fees paid to the
`
`USPTO in connection with this proceeding, totaling $15,000, to be paid to Deposit
`
`Account No. 16-0605 (referencing matter number 067115/520656).
