`INTRODUCTION
`Pursuant to 35 U.S.C. § 312 and 37 C.F.R. § 42.104, GoPro, Inc., Garmin
`
`Int’l, Inc. and Garmin USA, Inc. (“Petitioners”) respectfully request that the Board
`
`institute inter partes review (“IPR”) of claims 1-22 of U.S. Patent No. 9,258,698.
`
`This petition is based on grounds identical to those already instituted in Case
`
`Nos. IPR2019-00127 filed by Canon U.S.A, Inc. A motion for joinder is being
`
`filed simultaneously with this petition.
`
`The provisional application underlying the ’698 Patent was filed
`
`December 28, 2007. By that time, cellular phones, digital cameras, Bluetooth, and
`
`photo-sharing webpages were all well known for more than a decade. The alleged
`
`invention of the ’698 Patent simply combines these technologies into a system
`
`where a digital camera connects to a cellular phone over Bluetooth in order to send
`
`it image files, and the phone uploads the images to a website. There is nothing
`
`inventive or non-obvious about the combination.1 Notably, the claims of the ’698
`
`Patent were allowed only after the applicant agreed to an Examiner’s Amendment
`
`

`claims of the ’698 Patent were directed to non-patentable subject matter under 35
`
`U.S.C. § 101 and dismissed Patent Owner’s suit against Petitioner. Ex. 1021. That

`that added the simple requirement of the cellular phone including a user interface
`
`to delete an image file created by the digital camera. The prior art discussed in this
`
`Petition—none of which was before the Examiner during prosecution—shows that
`
`this limitation was well known and used in combination with systems that
`
`transferred image files between digital cameras and cellular phones.
`
`In light of this prior art, and for the reasons discussed in the grounds
`
`presented below, Petitioners request that the Board institute IPR and cancel each
`
`challenged claim.
`
`II. MANDATORY NOTICES

`The real-parties-in-interest are Petitioners GoPro, Inc., Garmin Int’l, Inc. and
`
`Garmin USA, Inc. Garmin International, Inc. also identifies as a real party-in-

`B. Related Matters – 37 C.F.R. § 42.8(b)(2)
`Patent Owner Cellspin Soft, Inc. (“Cellspin”) has asserted the ’698 Patent
`
`against Petitioners in Cellspin Soft, Inc. v. GoPro, Inc., No. 4:17-cv-005939 and
`
`Cellspin Soft, Inc. v. Garmin International et al., No. 4:17-cv-05934 in the U.S.
`
`District Court for the Northern District of California. The court in that case granted
`
`Petitioner’s motion to dismiss on the grounds that the claims of the ’698 Patent are
`
`directed to non-patentable subject matter under 35 U.S.C. § 101 and the Supreme
`
`Court’s framework set forth in Alice Corp. Pty. Ltd. v. CLS Bank Int’l, 134 S.Ct.

`2347 (2014). Ex. 1021. Patent Owner’s appeal of that decision is currently pending
`
`before the U.S. Court of Appeals for the Federal Circuit, Appeal No. 2018-1823.
`
`The lead case for the appeal is Appeal No. 2018-1817.
`
`Patent Owner has also asserted the ’698 Patent against JK Imaging, Ltd. in
`
`Case No. 4:17-cv-06881, Nikon Americas Inc., et al. in Case No. 4:17-cv-05936,
`
`TomTom Inc. et al. in Case No. 4:17-cv-05937, Canon USA, Inc., in Case No.
`
`4:17-cv-05938, Eastman Kodak Co. in Case No. 4:17-cv-05940, and Panasonic
`
`Corporation of America in Case No. 4:17-cv-05941, all of which were filed in the
`
`United States District Court for the Northern District of California. The cases
`
`against JK Imaging, GoPro, and Panasonic were dismissed on the grounds that the
`
`claims of the ’698 Patent are directed to non-patentable subject matter, and are
`
`currently on appeal as part of lead case Appeal No. 2018-1817. The cases against
`
`TomTom and Eastman Kodak were dismissed. The case against Nikon remains
`
`pending.

`Pursuant to 37 C.F.R. § 42.104(b)(5), the exhibit numbers of the supporting
`
`evidence relied upon and the relevance of the evidence to the challenges raised are
`
`provided herein. An Exhibit List identifying the exhibits is included supra, iv-vi.

`In support of the proposed grounds, this Petition is accompanied by the declaration
`
`of Mr. Gerald Christensen (Ex. 1033), an expert in the fields of electrical and
`
`computer engineering with extensive experience in consumer electronics and
`
`wireless communication. Ex. 1034. Mr. Christensen has reviewed, agreed with and
`
`adopted the detailed views and opinions expressed by Dr. Vijay Madisetti in
`
`Sections V (“Technology Overview”), VI (“The ’698 Patent”), VIII (“Overview of
`
`the Prior Art”), and IX (“Grounds for Invalidity”) of his declaration (Ex. 1003) in
`
`support of IPR2019-00127. Ex. 1033. Relevant views and opinions expressed in
`
`those sections of Dr. Madisetti’s declaration are referenced hereinafter in the
`
`remainder of the petition.

`VI. THE ’698 PATENT
`Specification
`A.
`The ’698 Patent is directed to “a method and system for utilizing a digital
`
`data capture device in conjunction with a Bluetooth (BT) enabled mobile device
`
`for publishing data and multimedia content on one or more websites automatically
`
`or with minimal user intervention.” Ex. 1001, Abstract. The background of the
`
`specification characterizes the prior art as requiring a user to transfer images
`

`offline to a PC using a USB, cable, or memory stick, and then manually upload the
`
`image onto a website. Id. 1:50-55.
`
`The solution that the ’698 Patent proposes is to transfer image files from a
`
`digital camera to a mobile device using a wireless Bluetooth connection. Id. 2:5-
`
`11. The patent then proposes a software application on the mobile device that
`
`allows the image files to be uploaded to a website. Id. 2:53-61. Figure 2 illustrates
`
`the components of the digital camera 201 and mobile device 203, including the
`
`Bluetooth connection between them:

`Figure 4 shows the connection between mobile device and publishing
`
`service 401 over network 402, which allows the mobile device to upload image
`
`files received from the camera to a website:

`The specification explains that the system may use HTTP to transfer data
`
`from the mobile device to the publishing service. Id. 10:9-15. The specification
`
`identifies examples of publishing services, including Flickr™, Picasa™, YouTube™,
`
`and eBay®, as well as personal blogs. Id. 8:51-55, 9:32-35.

`B.
`
`Prosecution History
`
`The ’698 Patent was filed with 30 claims. Ex. 1002. The independent claims
`
`were directed to a digital camera in communication with a mobile device that
`
`initiated a transfer of new-media files created on the camera and was configured to
`
`upload the files to a website. Id. 21-33. The Examiner issued a Non-Final
`
`Rejection finding all claims obvious in light of various prior art. Id. 65-73. The
`
`Applicant amended the claims to require, inter alia, that the camera store the new
`
`image files in “non-volatile memory” and that the upload uses HTTP. Id. 89.

`The Examiner issued a Final Rejection that maintained the claims were
`
`obvious. Id. 132. After an RCE, the Examiner issued a Non-Final Rejection. Id.
`
`231-42. The Applicant amended the independent claims to require, inter alia, that
`
`the new-media file is created in the camera before it receives a transfer request, and
`
`that the website is a user media publishing website. Id. 249. The Examiner issued
`
`another Final Rejection of all claims as obvious. Id. 305. The Applicant and
`
`Examiner held an interview during which the Examiner proposed the following
`
`amendment to put the claims in allowable form, which the applicant subsequently

`establishing the short-range paired wireless connection between the
`digital camera device and the cellular phone;
`creating a new-media file using the acquired new-media;
`storing the created new-media file in a first non-volatile memory of the
`digital camera device;
`receiving a data transfer request initiated by a mobile software
`application on the cellular phone, over the established short-range paired
`wireless connection, wherein the data transfer request is for the new-
`media file, and wherein the new-media file was created in the digital
`camera device before receiving the data transfer request; and
`transferring the new-media file to the cellular phone, over the established
`short-range paired wireless connection, wherein the cellular phone is
`configured to receive the new-media file, wherein the cellular phone is
`configured to store the received new-media file in a non-volatile memory
`device of the cellular phone,
`1(i) wherein the cellular phone is configured to use HTTP to upload the
`received new-media file along with user information to a user media
`publishing website, and
`1(j) wherein the cellular phone is configured to provide a graphical user
`interface (GUI) in the cellular phone, wherein the graphical user
`interface (GUI) is for the received new-media file and to delete the
`created new-media file.

`media publishing website to publish the new-media file.

`The machine implemented method of claim 1, wherein the new-media
`comprises one or more of video data and image data.

`5(a) A short-range wireless enabled digital camera device, comprising:
`5(b) a first non-volatile memory device; a first processor coupled to said first
`non-volatile memory device;
`a short-range wireless communication device configured to control the
`first processor to establish a short-range paired wireless connection
`between the short-range wireless enabled digital camera device and a
`short-range wireless enabled cellular phone, wherein establishing the
`short-range paired wireless connection comprises, the digital camera
`device cryptographically authenticating identity of the cellular phone;
`5(d) a data capture circuitry; said first processor configured to acquire new-
`media in the digital camera device using the data capture circuitry,
`wherein the new-media is acquired after establishing the short-range
`paired wireless connection between the digital camera device and the

`interface (GUI) is configured to receive input to delete the created new-
