`
`DECLARATION OF YOSH MORIARTY
`REGARDING FINGER TIPS GUIDE and iOS USER GUIDE
`
`I, Yosh Moriarty, declare as follows:
`
`Apple Ex. 1031
`Apple Inc. v. Firstface Co., Ltd.
`IPR2019-00613
`Page 00001
`
`
`
`1.
`
`I am over the age of eighteen (18) and otherwise competent to make this
`
`Declaration. All statements herein made of my own knowledge are true, and
`
`all statements herein made based on information and belief are believed to
`
`be true. I am not being compensated for my time in preparing this
`
`declaration outside of my regular compensation. The opinions herein are my
`
`own, and I have no personal stake in the outcome of the petitions for inter
`
`partes review filed against the above captioned patents or any related
`
`litigation or administrative proceeding.
`
`I am currently employed at Apple Inc. (“Apple”) and have worked at Apple
`
`since January 4, 1988.
`
`I am currently a Sr. Print Production Manager in the Instructional Products
`
`2.
`
`3.
`
`department.
`
` I also work with the print suppliers around the
`
`world to ensure that all our print pieces are printed correctly and meet
`
`Apple’s quality standards.
`
`4.
`
`I have been asked to explain the document attached hereto as Attachment A,
`
`iPhone 3G Finger Tips (Ex. 1032, “Finger Tips Guide,” having part number
`
`IPR2019-00613 Page 00002
`
`
`
`034-4989-A), and, more specifically, what this document contains and when
`
`this document was distributed by Apple to members of the public. The
`
`Finger Tips Guide attached as Attachment A is a true and accurate copy of
`
`the iPhone 3G Finger Tips document saved in Apple’s archives (discussed in
`
`more detail below).
`
`5.
`
`The Finger Tips Guide is a 20-page (10-panel) accordion fold pamphlet that
`
`provided operating information for new users to start using an iPhone. For
`
`example, it included basic information about operation of the iPhone (its
`
`buttons and touchscreen display), setting up a user account, and app
`
`functionality. The last page of the Finger Tips Guide then referred users to
`
`the more detailed iPhone User Guide at the Apple Support site
`
`(help.apple.com/iphone and www.apple.com/support/iphone).
`
`
`
`IPR2019-00613 Page 00003
`
`
`
`The last page of the Finger Tips Guide has the text “© 2009 Apple Inc.” and
`
`“034-4989-A.”
`
`SS I confirm that
`
`the Finger Tips Guide, having the part number
`
`034-4989-A, was printed and packaged with iPhone devices sold to the
`
`public starting in June 2009. Once printed,
`
`this document was packaged
`
`along with other documentation (support,
`
`legal, warranty) and the iPhone
`
`device itself to be sold to the public.

`
`
`
`7.
`
`In signing this declaration, I understand that the declaration will be filed as
`
`evidence in review proceedings before the Patent Trial and Appeal Board of
`
`the U.S. Patent and Trademark Office. I acknowledge that I may be subject
`
`to cross-examination in the cases and that such cross-examination would
`
`take place within the United States. If cross-examination is required of me, I
`
`will appear for cross-examination within the United States during the time
`
`allotted for cross-examination.
`
`8.
`
`I hereby declare that all statements made herein of my own knowledge are
`
`true and that all statements made on information and belief are believed to
`
`be true; and further that these statements were made with the knowledge that
`
`willful false statements and the like so made are punishable by fine or
`
`imprisonment, or both, under Section 1001 of the Title 18 of the United
`
`States Code and that such willful false statements may jeopardize the results
`
`of these proceedings.
