`From approximately January 2018 to at least June 2018, a third party, Gate
`
`Worldwide Holdings LLC (“GWH”), asserted it had become the owner of all of
`
`Nomadix’s patents, including the ’922 patent. On January 12, 2018, GWH
`
`arranged for another third party, David L. Anderson, to execute an “assignment” of
`
`Nomadix’s patents to GWH, purportedly on behalf of Nomadix. Mr. Anderson is
`
`not an officer, director, or employee of Nomadix. He had no authority to act on
`
`behalf of Nomadix, and Nomadix did not otherwise authorize the assignment.
`
`GWH recorded with the PTO the assignment document it had Mr. Anderson sign.
`
`That document is available at reel 45113, frame 928.
`
`Nomadix disputes the effectiveness of the assignment document and
`
`maintains that it remains the owner of the ’922 patent.
`
`Petitioner Guest Tek Interactive Entertainment Ltd. has been aware of
`
`GWH’s claims since January 2018. Petitioner’s certificate of service does not
`
`indicate that Petitioner served GWH with the petition and accompanying papers.

`Guest Tek Interactive Entertainment Ltd. v. Nomadix, Inc.
`GWH has filed an action against Nomadix and other defendants, seeking,
`
`among other things, to recover on a promissory note and to foreclose on collateral
`
`securing the note, which GWH contends includes Nomadix’s patents, including the
`
`’922 patent. The case is Gate Worldwide Holdings LLC v. interTouch Holdings
`
`LLC et al., Index No. 650026/2018, pending in the Supreme Court of New York.
`
`Based on developments in that litigation and other litigation, including
`
`statements made by GWH, Nomadix understands GWH to no longer contest
`
`Nomadix’s present ownership of the ’922 patent. Nonetheless, Nomadix has
`
`included the foregoing information about GWH’s allegations and claims in an
`
`abundance of caution.
