`over 200 speeches, lectures, workshops and classes on aspects of information
`
`authenticity, information flow in our society, intellectual property, and
`
`confidentiality with regards to information access.

`establish the dates of public accessibility of certain documents in an inter partes
`
`review proceeding for U.S. Patent No. 7,779,011. For this service, I am being

`the substance of my testimony or the outcome of this proceeding.

`III. PRELIMINARIES

`Scope of this declaration. I am not a lawyer and I am not rendering
`
`an opinion on the legal question of whether any particular document is, or is not, a
`
`“printed publication” under the law.
`

`I am, however, rendering my expert opinion on the authenticity of the
`
`documents referenced herein and on when and how each of these documents was
`
`disseminated or otherwise made available to the extent that persons interested and
`
`ordinarily skilled in the subject matter or art, exercising reasonable diligence,
`
`could have located the documents.
`
`10. Materials considered. In forming the opinions expressed in this
`
`declaration, I have reviewed the documents and attachments referenced herein.
`
`These materials are records created in the ordinary course of business by
`
`businesses, publishers, libraries, indexing services, and others. From my years of
`

`experience, I am familiar with the process for creating many of these records, and
`
`I know these records are created by people with knowledge of the information in
`
`the record. Further, these records are created with the expectation that researchers

`IV. OPINIONS REGARDING DOCUMENT 1
`Document 1: Nokia 3220 User Manual—Appendix C to Exhibit 1214 in
`IPR2019-00239.

`Authentication
`11. Document 1 is a user guide for a Nokia 3220 cellular telephone.
`
`Page iii of Document 1 (as shown below) indicates that the document was printed
`
`in Canada in September of 2004. Document 1 also indicates that it was
`
`copyrighted by Nokia in 2004. In addition, absent the cover page and Appendices
`
`to Document 1, the bottom of each page, including the final page, indicates a
`
`notice of “Copyright © 2004 Nokia”. Finally, the last page also includes a notation
`
`of “09/04” in the lower left corner, indicating a date stamp of September 2004,
`
`which matches the same information shown on page iii (as shown below). The
`
`consistency of these dates suggests authenticity to me.

`12. Attachment 1a is a true and correct copy of Document 1 (along with
`
`the volume cover, inside cover, editorial and other information page, and contents
`
`pages) obtained from an online repository for product manuals1.
`
`13. Attachment 1a is in a condition that creates no suspicion about its
`
`authenticity. Specifically, attachment 1a is not missing any intermediate pages of
`
`the manual’s text, the text on each page appears to flow seamlessly from one page
`
`to the next, and there are no visible alterations to the document. Attachment 1a
`
`was found within an online repository for product manuals – a place where, if
`
`authentic, it would likely be found.
`
`14. Document 1 is also readily available via other online avenues. For
`
`instance, attachment 1b is a true and correct copy of Document 1 that was
`
`

`obtained from the website of a cellular service provider2. In my opinion,
`
`attachment 1b is the same document as Document 1.
`
`15. Attachment 1b is in a condition that creates no suspicion about its
`
`authenticity. Specifically, attachment 1b is not missing any intermediate pages of
`
`the manual’s text, the text on each page appears to flow seamlessly from one page
`
`to the next, and there are no visible alterations to the document. Further, the
`
`website of a cellular service provider is also a place where, if authentic, Document
`
`1 would likely be found.
`
`16.

`I have examined the copies of Document 1 in attachments 1a and 1b
`
`and find them to be the substantively the same document. It is my opinion that
`
`attachments 1a and 1b are authentic copies of Document 1.
`
`17.
`
`I conclude, based on finding multiple, virtually identical copies of
`
`Document 1 online at multiple websites, that Document 1 is authentic.
`

`Public Accessibility
` In order to discover the date the Nokia 3220 was released to the
`

`public, I entered "Nokia 3220 Press Release" into the search engine at
`
`Google.com. The first search result was an entry from the Securities and
`
`

`Exchange Commission3 for a Form 6-K, which included a press release by Nokia
`
`concerning the phone on May 31, 2004. The press release indicates, “With a burst
`
`of rhythmic, flashing lights, the Nokia 3220 camera phone, signaled its arrival –
`
`and an innovative way to communicate with friends in a crowd. Unveiled today at
`
`Nokia Totally Board in Thessaloniki, Greece, the Nokia 3220 is highlighted by
`
`transparent Nokia Xpress-On™ grips, which pulsate with light effects to indicate
`
`calls, messages, and in sync with the beat of ringtones.” I then
`
`visited www.phonearena.com, which stated that the phone was announced on May
`
`31, 2004. Based on the information from these two websites, I concluded that it
`
`was likely that the Nokia 3220 was publicly released in 2004.
`
`19. As I noted above, page iii of Document 1 indicates that it was printed
`
`in Canada in September of 2004. As the world wide web became ubiquitous, in
`
`addition to providing hard copies of user manuals to consumers, companies also
`
`placed manuals online and directed consumers to their websites to retrieve the
`
`manuals. This appears to have been the case for Document 1.
`
`

`20. Document 1 was found on publicly accessible websites.
`
`Google.com is the most used search engine in the United States and a highly
`
`respected search engine throughout the world.
`
`21.

`I began by learning that the Nokia 3220 was introduced to the market
`
`in 2004. In order to discover publicly accessible websites where copies of
`
`Document 1 are located and were located in 2004, I went to Google.com and
`
`completed a search for “Nokia 3220 manual”. After Google.com displayed search
`
`results for “Nokia 3220 manual”, I clicked on the “tools” button in the web
`
`browser user interface. This resulted in Google.com allowing me to run a more
`
`detailed query involving dates. I selected a date range of 2002 to 2006. The year
`
`2002 was selected because it is before the known date of introduction. The search
`
`results show that a copy of Document 1 was available on publicly accessible
`
`websites as early as September 15, 2004 at
`
`https://www.wireless.att.com/download/phone_manual/nokia_3220.pdf.
`
`22. For instance, the image below is an excerpt of a screenshot taken
`
`from a Google.com search. It indicates a date of September 15, 2004 (highlighted
`
`with the red box around it.)

`23. According to the Google Search Help, this date in Google indicates

`the date it was published. It is my opinion that the date indicates that this copy of
`
`Document 1 was publicly available by September 15, 2004.

`In view of the foregoing, it is my opinion that Document 1 was
`
`available to the public as early as September 15, 2004.
`

`Conclusions Regarding Authenticity and Public
`Accessibility
`25. Based on the evidence presented here—publication on publicly

`accessible websites—it is my opinion that Document 1 is an authentic
`
`document that was publicly available by at least September 15, 2004.
