`U.S. Patent No. 7,868,912 ("the '912 patent"), 1 entitled "Video Surveillance System
`
`Employing Video Primitives," is generally directed to methods, devices, and computer-readable
`
`storage media for video surveillance. See U.S. Patent Application No. 09/987,707 ("the '707
`
`application"), Abstract.2 The claimed methods, devices, and computer-readable storage media
`
`improve prior art video surveillance by separating the processes of ( 1) extracting attributes of
`
`objects (i.e., primitives) detected in a video and (2) applying rules to those attributes to
`
`independently identify events. See '707 application at Figs. 4 & 9. For example, Figure 4
`
`illustrates an embodiment that supports separating these two processes.

`Block 42 represents the process of extracting attributes, in the form of video primitives,
`from the objects. See '707 application at ,r 106. These primitives include observable
`characteristics of the objects. See id. at ,r 80. Separately, in block 44, event occurrences are
`identified by comparing those attributes to a set of event discriminators (i.e., rules) that facilitate
`"inference analysis" based on video primitives. See id. at ,r,r 67 & 118.
`The power of this separation is that the identification of an event can be performed
`
`independent of the extraction of object attributes. Thus, the events do not need to be preset by
`
`the system at the time or location that the object attributes are extracted. "[T]he system can
`
`perform inference analysis based on the previously recorded video primitives." '707 application
`at ,r 67.
`

`Inferring events based on the attributes (or primitives) provides several advantages. First,
`
`"[a]n operator is provided with maximum flexibility in configuring the system by using event
`discriminators," '707 application at ,i 66, as opposed to the limitations associated with using
`
`prerecorded events. Second, inference analysis based on previously extracted attributes "greatly
`
`improves the analysis speed of the computer system" as the system can process the attributes
`only instead ofreprocessing the video. See id. at ,i 67. Third, inventing a system for analyzing
`
`"small-sized video primitives abstracted from the video" has many corresponding size-based
`benefits. Id. at ,r 148. For example, the storage space and bandwidth space necessary to manage
`the small-sized attributes is far less than the space for managing the video itself, even if the video
`
`is highly compressed. See id. All of these benefits flow from the claimed methods, devices, and
`
`computer-readable storage media that make the extraction of attributes independent from the
`
`events that the operator tasks the system to identify.
`
`II.
`
`Procedural Background
`
`On February 29, 2012, a request for inter partes reexamination of the '912 patent was
`
`filed by Bosch Security Systems, Inc., a subsidiary of Robert Bosch GMBH ("Bosch"). On April
`
`10, 2012, the Office granted the request. On December 3, 2012, Patent Owner filed a Petition to
`
`Terminate Reexamination Proceeding Under 35 U .S.C. § 317(b) and 3 7 CFR §§ 1.182,
`
`l .907(b ). The Petition included a Stipulation and Order of Dismissal from a related district court
`
`patent infringement action in which Bosch stipulated and requested that the Court order that
`
`Bosch has not sustained its burden of proving the invalidity of any of the claims 1-22 of the '912
`
`patent. On February 13, 2013, the Office issued a Decision granting the Petition and terminating
`
`the inter partes reexamination of the '912 patent.
`
`On May 24, 2013, an anonymous requester (the "Requester") submitted a Request for Ex
`
`Parte Reexamination ("the Request") of claims 1-22 of the '912 patent. On June 20, 2013, the
`
`Office issued an Order ("the Order") granting the Request. On August 30, 2013, the Office
`
`issued an Office Action ("the Office Action") rejecting claims 1-22 under 35 U .S.C. § 102(b)
`
`and/or under 35 U.S.C. § I 03(a). Patent Owner respectfully submits that the cited references do
`
`not anticipate and would not have rendered obvious the subject matter of any of the rejected
`
`claims. Accordingly, all rejections are traversed, and reconsideration is respectfully requested.

`Patent Owner, Object Video, Inc. representatives Gary Myers and Mitchell Herbert,
`
`technical expert Ken Zeger, and Patent Owner's representatives, Nancy Linck, Martin Zoltick,

`and Michael Battaglia, wish to thank Examiners Basehoar and Bonshock and Supervisory Patent
`
`Examiner Kosowski for extending the courtesy of the interview held on October 9, 2013, and for
`
`the helpful and courteous discussions. Patent Owner and Patent Owner's representatives believe
`
`that reexamination of the '912 patent was materially advanced based on the discussion of the
`
`pending claims, the cited references, and the pending rejections. An Agenda for the Interview
`
`and accompanying slide presentation were filed with the Office on October 7, 2013. The Agenda
`
`items were discussed and the slides were presented, including animations comparing an example
`
`of the claimed invention to the system disclosed in the Day reference. The following reasons

`. warranting withdrawal of the rejections were addressed during the interview:
