`August 1, 2018, Petitionerfiled its “Petition for Inter Partes Review

`ofU.S. Patent No. 8,921,348 and Mandatory
`
`Notices Under 37 C.F.R. § 42.8”,
`
`which included the
`
`designation of lead and backup counsel as listed above.
`
`The Patent Owners
`
`implicitly acknowledged this designation of lead and
`
`backup
`
`counsel
`
`by serving its papers in this action on both of these attorneys
`
`on
`
`August 23, 2018.
`
`However, concomitant with the August 1, 2018, filing,
`
`Petitioner also
`
`filed a Power of
`
`Attorney, designating only
`
`Kenneth M. Goldman as the
`
`
`
`IPR2018-01494
`U.S. Patent No. 8,921,348
`appointed lead counsel, and the PTAB website lists only Mr. Goldman aslead
`
`counsel in this matter. This sole designation

`was and is clearly
`
`in error.

`clarify and/or correct the actual situation.
