`I, Leonard A. Gail, resident of Chicago, Illinois, hereby declare as

`follows:

`1. I am an attorney at the firm of Massey & Gail LLP, counsel for

`Petitioner Neptune Generics, LLC (“Neptune”). I have personal knowledge of
`
`the facts set forth in this declaration, and if called as a witness, could and
`
`would testify under oath.
`
`2. I am a member in good standing of the Illinois State Bar (Bar No.

`3. I have never been suspended or disbarred from practice before any
`
`court or administrative body. No application of mine for admission to practice
`
`before any court or administrative body has ever been denied. I have never
`
`had a sanction or contempt citation imposed on me by any court or
`
`administrative body.

`4. I have read and will comply with the Office Patent Trial Practice
`
`Guide and Board’s Rules of Practice for Trials set forth in part 42 of 37 C.F.R.

`I acknowledge and agree that I will be subject to the USPTO Rules of

`Professional Conduct set forth in 37 C.F.R. §§ 11.101 et seq. and disciplinary

`5. I received a Bachelor of Arts Degree from Dartmouth College in
`
`1985, and a law degree from Harvard University in 1988.
`
`6. I am a founding partner of Massey & Gail LLP (founded in 2008). I
`
`have three decades of experience in civil and criminal trials and litigation. I
`
`have been involved in litigation,
`
`trials, and counseling related to patent
`
`disputes throughout much of my law firm career.
`
`7. I have been actively involved in analyzing and assisting with the
`
`Petition for Inter Partes Review submitted in this proceeding.
`
`8. I have not appeared pro hac vice in any proceedings before the
`
`USPTO.
`
`9. I further declare that all statements made in this declaration are of my
`
`own knowledge and are true and that all statements made on information and
`
`belief are believed to be true. I also declare that these statements were made
`
`with the knowledge that willful false statements and the like so made are
`
`punishable by fine or imprisonment, or both under Section 1001 of Title 18 of
`
`the United States Code.
