`L Brian Dunance, being over the age of eighteen, hereby declare the following based on my

`personal knowledge:

`I was employed in the circulation department of University of Michigan Library System
`
`("the University Library") from approximately 1983 until at least 1985. During this time
`
`my responsibi lities and duties included: managing journal collections; working with
`
`technical processing, bindc1y, and circulation departments; and intaking, organizing and
`
`cataloging journals. During this time I also received on-the-job training in library science
`
`and particularly the University Library procedures.
`
`2. Through my employment with the Un iversity Library, I became aware of the University
`
`Libra1y's hard copy cataloging system, call number system, and procedure for receiving
`
`and entering materials into the catalog. Generally, after a journal was received in the
`
`mai l, it was stamped, indexed in the Library's catalog, and shelved by the Library within
`
`a week's time.
`
`3. I have worked for ATC Services, a document search and delivety company, from the late
`
`l 980's through the present day. l currently hold the title of General Manager for AfC
`
`Services. Throughout my time working for AIC Services, including the time period of
`
`the mid-to-late l 990's, I have frequently visited libraries, including the University
`
`Library. to obtain reference materials.
`
`4. Through work for ATC Services and my time obtaining reference materials from the
`
`University Libraty, T kept cuJTent my knowledge and understanding of the University
`
`Libra1y's hard copy cataloging system. I also became familiar with the University
`

`Library's electronic cataloging system, including electronic searching options, call
`
`number system, and procedure for receiving and entering materials into the catalog.
`
`During my time working for ATC Services, I have observed that the University Library's
`
`hard copy cataloging system and electronic cataloging system each permit a user to
`
`conduct subject matter searches and are each accessible to the general public. I have also
`
`frequently observed reference materials that were shelved shortly after the date of the
`
`date stamp.
`
`5. Attached as Exhibit I is a true and correct copy of excerpts of IEEE Transactions on
`
`Antennas and Propagation, April 1998. Volume 46, Number 4, ISSN 00 I 8-926X ("the
`
`April 1998 Publication") that I obtained from the University of Michigan Media Union
`
`Library when I physically entered the University of Michigan Media Union Library,
`
`found the call number for the April 1998 Publication, and retrieved a hard copy the same
`
`from the University Library stacks. Exhibi t 1 includes the cover page and the table of
`
`contents of the April 1998 Publication and an article from the April 1998 Publication
`
`entitled, Study of Impedance and Radiation Properties of a Concentric Microstrip
`
`Triangular-Ring A 11te1111a and Its Modeling Techniques Using FDTD Method, lti Saha
`
`M isra and S.K. Chowdhmy ("Misra f'). Exhibit 1 is date-stamped April L6, I 998.

`6. Attached as Exhibit 2 is a tme and correct copy of excerpts of Microwave and Optical
`
`Technology Letters, February 5, 1996, Volume 11 I Number 2, ISSN 0895-2477 ("the
`
`February 1996 .Publ ication") that I obtained from the Un i\'ersity of Michigan Engineering
`
`Library when l physically entered the University of Michigan Engineering Library, found
`
`the call number for the February 1996 Publication, and retrieved a hard copy the same
`
`from the University Library stacks. Exhibit 2 includes the cover page and the table of
`

`/I"). Exhibit 2 is date-stamped January 26, 1996.

`7. The publications attached as Exhibit 1 & 2 were searchable through the University
`
`Library's hard copy catalog and on line catalog. To the best of my knowledge, and based
`
`on the University Library's ordinary procedures, tbc publications attached as Exhibit l &
`
`2 were available to patrons for viewing and making copies within a week's time after the
`
`publications' respective date stamp.
`
`8. To the best of my knowledge, and based on the University Library's ordinary procedures,
`
`the publications attached as Exhibit I & 2 were each stored at the University Library in a
`
`condition that creates no suspicion about their authenticity and in a place where they
`
`would likely be, if authentic. For example, the publications attached as Exhibit I & 2
`
`were each stored on shelves corresponding to their respective call numbers in a manner
`
`consistent with other publications of the same type and age.
`
