`INTRODUCTION
`In its Institution Decision, the Board found that Petitioner (“Apple”)
`
`I.

`established a reasonable likelihood that claims 1–5, 8–10, and 12–20 (“the
`
`Challenged Claims”) of U.S. Patent No. 9,024,418 (“the ’418 patent”) are
`
`unpatentable for the reasons advanced in the Petition. Qualcomm’s arguments
`
`with respect to the cited prior art fail to rebut the positions advanced in the
`
`Petition. In addition, the Board should reject Qualcomm’s attempt to swear behind
`
`the prior art references cited in the Petition, because Qualcomm fails to provide
`
`sufficient evidence showing that the inventors both conceived and reduced to
`
`practice the subject matter described in the ’418 patent prior to the effective dates
`
`of the cited prior art references. Accordingly, the Board should echo the reasoning
`
`and holding from its Institution Decision in its Final Written Decision, and find the
`
`Challenged Claims unpatentable.

`III. QUALCOMM FAILS TO REBUT THE INSTITUTED GROUNDS OF
`UNPATENTABILITY
`Claims 1-5, 8-10, and 12-20 of the ’418 patent are unpatentable for the
`
`reasons described in the Petition. See Petition, 14-74. As described below, the
`
`arguments presented by Qualcomm in its POR fail to rebut the prior art arguments
`
`presented in the Petition.
`
`A. The power rails of Rashed are diffusion-directed local
`interconnects configured to couple the first gate layer to one of the
`first and second gate-directed local interconnects (claim 1)
`As shown in the Petition, the power rails 140H and 140L described in
`
`Rashed teach a “diffusion-directed local interconnect layer configured to couple
`
`the first gate layer to one of the first and second gate-directed local interconnects,”
`
`as recited in claim 1. See, e.g., Petition, 28-30. Qualcomm argues that that the
`
`power rails 140H and 140L do not teach this limitation, because “Rashed does not
`
`describe the power rails as configured to couple structures connected to the power
`
`rails to each other.” POR, 50.
`
`But, as shown in the petition, the power rails do, in fact, provide a coupling
`
`between the structures in question. The Petition states that “power rail 140H
`
`(shown in beige) is coupled to the isolating electrode 150PG and the source region
`
`of PFET 120P2 through conductive structure 144 or conductive contact 190P[.]”
`
`Petition, 28 (citing APPLE-1005, 6:23-54, 5:18-40; APPLE-1003, [60]). The

`Petition further states that “power rail 140L (shown in beige) is coupled to the

`isolating electrode 150NG and the source region of NFET 122N2 through
`
`conductive structure 146 or conductive contact 190N.” Petition, 28 (citing
`
`APPLE-1005, 6:23-54, 5:18-40; APPLE-1003, [61]). This configuration is shown
`
`in the following annotated version of Rashed’s FIG. 5 included in the Petition:

`Because the power rails 140L and 140H do, in fact, couple the structures in
`
`question to one another, as opposed to simply being “capable of” doing so, the
`
`power rails 140L and 140H are “configured to” provide this coupling, as described
`
`in the Petition. See Petition, 28-30.

`B. Claims 1 and 12 do not require the “diffusion-directed local
`interconnect” to be in physical contact with the “first gate layer”
`Qualcomm argues that “Petitioner’s purported ‘diffusion-directed local
`
`interconnect’ is not in physical contact with Petitioner’s purported ‘first gate
`
`layer.’” POR, 51. Several of Qualcomm’s arguments hinge on this “physical
`
`contact” requirement. See, e.g., POR, 51-61. However, the language of claims 1
`
`and 12 does not require direct physical contact between the “diffusion-directed
`
`local interconnect” and the “first gate layer.” Claim 1 recites “a diffusion-directed
`
`local interconnect layer configured to couple the first gate layer to one of the first
`
`and second gate-directed local interconnects.” APPLE-1001, claim 1 (emphasis
`
`added). Claim 12 recites “forming a diffusion-directed local interconnect to couple
`
`one of the first and second gate-connected local interconnects to the first gate
`
`layer.” Id., claim 12 (emphasis added).
`
`Qualcomm does not provide any argument or evidence that “coupling,” in
`
`the context of the ’418 patent, requires direct physical contact between
`
`components. And this omission is despite the arguments advanced by Petitioner in
`
`the Petition, which argues, based on case law, that coupling “encompass[es] both
`
`direct and indirect connections from one component to another.” Petition, 41
`
`(citing Silicon Graphics, Inc. v. nVidia Corp., 58 F. Supp. 2d 331, 346 (D. Del.
`
`1999); GSK Technologies Inc. v. Eaton Elec. Inc., 2008 WL 906713, *5 (E.D.
