`
`REMARKS
`
`The above-identified application was allowed in the Notice of Allowance mailed
`
`February 2, 2012. The issue fee has not yet been paid.
`
`Subsequent to the receipt of the Notice of Allowance and the Examiner's
`
`Amendment of February 2, 2012, Applicant identified typographical errors in
`
`independent claim 25 and dependent claim 48 of the Examiner's Amendment of
`
`February 2, 2012. Claim 25 inadvertently included language that was struck-through in
`
`Applicant's Amendment filed November 7, 2011. In addition, claim 48 inadvertently
`
`removed language that was underlined in Applicant's Amendment filed November 7,
`
`2011. In the interest of clarity and consistency, by this Amendment, Applicant has
`
`amended claims 25 and 48 to include the language of the pending claims in the
`
`Amendment filed November 7, 2011 modified only by the Examiner's marked-up claim
`
`amendments in the Examiner's Amendment of February 2, 2012.
`
`In a voicemail left with Applicant's representative on February 24, 2012, the
`
`Examiner indicated that it would be appropriate for Applicant to submit this Amendment
`
`pursuant to 37 C.F.R. § 1.312, which Applicant has undertaken in this paper.
`
`Applicant respectfully submits that the above amendments are needed to correct
`
`the pending set of claims. Furthermore, the above amendments do not raise new
`
`issues, and consideration and allowance of the claims will not require additional search
`
`or consideration. Therefore, Applicant respectfully requests that this Amendment be
`
`entered and the requested changes made.

`
`Dear Commissioner:
`
`COMMENTS ON STATEMENT OF REASONS FOR ALLOWANCE
`
`Applicant thanks the Examiner for the Notice of Allowance mailed February 2,
`
`2012. Without withdrawing the allowed claims from issue, Applicant submits these
`
`comments for the record.
`
`In the Notice of Allowance, the Examiner provided a Statement of Reasons for
`
`Allowance, which made certain characterizations of the prior art and emphasized or
`
`focused on certain elements of the claims. See Notice of Allowance, pp. 10-12.
`
`Although Applicant agrees with the Examiner's ultimate conclusion that the claims are
`
`allowable, Applicant does not agree with all of the characterizations or assertions in the
`
`Examiner's Statement.
`
`For example, the Examiner emphasized portions of the allowed claims in the
`
`Examiner's Statement. Applicant respectfully submits that each of the allowed claims is

`
`patentable based on the subject matter defined by the claim language and the
`
`combination of recitations within the claims, and not just based on the specific portions
`
`emphasized by the Examiner. The claims also recite other combinations and features
`
`not referenced in the Examiner's Statement, which provide further bases for
`
`distinguishing the prior art of record. Applicant also does not subscribe to all of the
`
`Examiner's comments regarding the prior art. Therefore, Applicant declines to
`
`subscribe to any statement or characterization in the Notice of Allowance and the
`
`accompanying Statement of Reasons for Allowance.
`
`Should the Examiner disagree with Applicant's comments on the Statement of
`
`Reasons for Allowance, the Examiner is invited to contact the undersigned to resolve
`
`any such disagreements.
`
`If there is any fee due in connection with the filing of these Comments, please
`
`charge the fee to our deposit account 06-0916.
`
`Respectfully submitted,
