`I, Anthony H. Sheh, hereby state and declare as follows:

`I am counsel for Patent Owner Anacor Pharmaceuticals, Inc. in the
`
`inter partes review proceeding captioned above.

`On August 6, 2018, I attempted to electronically file Anacor's
`
`opposition to the pending motion for joinder (Paper No. 3). Despite attempts using
`
`both Chrome and Internet Explorer, attempts using different computers, and
`
`attempts using a different network, I was not able to successfully submit the filing
`
`through PT AB E2E.
`

`I attempted to contact the Board by phone. However, I was not able
`
`to speak with anyone as it was outside the Board's business hours.
`

`Pursuant to instructions posted on the Board's website (FAQ A2), I
`
`therefore served counsel for Petitioner Mylan Pharmaceuticals Inc. with the
`
`opposition papers by email. I also gave notice to the Board of the service by email.
`
`I hereby declare that all statements made herein of my own knowledge are

`true and that all statements made on information and belief are believed to be true,

`and further that these statements were made with the knowledge that willful false

`statements and the like so made are punishable by fine or imprisonment, or both,
