`After meeting and conferring with counsel for Patent Owner (SEVEN Networks) on Friday, September 28 and Monday, October 1,
`counsel for Petitioner (Samsung) wishes to address the following topics on the conference call with the Board that we requested in our
`September 28 e-mail (below):
`
`Issues Where The Parties Have Reached Agreements
`
`• Samsung requests seal of Exhibit 3001, which includes confidential communications between the parties that were undertaken regarding
`a case specific discovery dispute to ease the administrative burden of these specific proceedings and with the good faith assumption that
`they would be maintained confidential. The content of Exhibit 3001 are not themselves believed to inform the ultimate legal issues of this
`case. SEVEN Networks does not oppose.
`
`• Samsung requests a 10-page initial brief, to be filed by October 12th, to address RPI/privity issues raised by SEVEN Networks in Patent
`
`

`Owner Preliminary Responses (POPRs). SEVEN Networks does not object subject to the Board’s agreement to SEVEN Networks getting
`a reply brief as set forth in the next bullet.
`
`• SEVEN Networks requests a 6-page reply brief, to be filed by October 19th. Samsung does not object and agrees that the reply can
`address the production provided by Samsung to SEVEN on September 13th and any RPI election made by Google on October 5th,
`irrespective of whether Samsung’s brief addresses or does not address these items.
`
`• SEVEN Networks requests to enter production received from Samsung on September 13th into the following proceedings involving
`SEVEN and Google: IPR2018-01047/1048/1049/1050/1051/1052/1094/1095/1101/1102/1103/1104/1115/1116/1117/1118. Samsung
`does not oppose this request, subject to the following conditions, which SEVEN Networks does not oppose: (1) SEVEN Networks agrees
`in advance to share with Samsung IPR counsel any additional privity or RPI production exchanged with Google in the Google IPR
`proceedings, upon receipt of that production, under the same sealing terms it was produced in the Google IPR proceedings, subject to
`Google’s agreement; (2) SEVEN Networks accepts without further modification the joint motion to seal sent by Samsung to SEVEN
`Networks on September 13th with the production; and (3) authorization from the Board and agreement by Google to seal Samsung’s
`production in the Google IPR proceedings under the same terms set forth in the joint motion to seal sent by Samsung to SEVEN
`Networks on September 13th with the production.
`
`Issues Where The Parties Have Not Reached An Agreement
`
`• Samsung requests limited reply briefing to address each of two issues raised by various POPRs filed by SEVEN Networks. Specifically,
`in the POPRs filed in each of IPR2018-01106, IPR2018-01108, IPR2018-01124, and IPR2018-01125, SEVEN Networks advances: (1)
`arguments alleging claim construction obligations of Samsung, and (2) arguments alleging bases for Board application of discretion under
`325(d). Samsung believes that each argument is flawed, either in its legal or factual foundation. SEVEN Networks opposes this request.
