`RE: IPR2017-02187; IPR2017-02188; and IPR2018-00155: Request to Extend Deadline for Motions to
`Expunge
`
`EXTERNAL Email:

`Counsel:

`The Board entered an Order (Paper 67) in IPR2017‐02188, that indicated that the confidential material in
`various motions to seal filed by the parties in that case, would be preserved in confidence by the Board
`pending appeal.

`In view of the indication in the parties email to the Board of July 2, 2019, that Patent Owner does not oppose
`maintaining the respective confidential documents in these cases as confidential, the Board will enter a similar
`Order in IPR2017‐02187 and IPR2018‐00155 granting Petitioner’s Motion(s) to Seal in these cases, and
`preserving in confidence the materials noted in those motions pending appeal.

`If the parties have any questions they may contact the Board to set up a telephone conference.

`Thank you,

`CATERPILLAR v. WIRTGEN

`

`Dear PTAB,

`Motions to expunge are due in IPR2017‐02187 by Friday, July 5, and in IPR2017‐02188 and IPR2018‐00155 by Monday,
`July 8. Each of these IPRs involves confidential information that Caterpillar may rely on in a Federal Circuit appeal (to the
`extent there are any appeals). Thus, at this time, Caterpillar does not want to expunge any confidential information in
`these three proceedings. On the other hand, Caterpillar also does not want the confidential information to go
`public.  Therefore, Caterpillar requests that the Board extend the deadline for filing motions to expunge until 30 days
`after the Federal Circuit mandate issues in the event of an appeal, or 30 days after the deadline for filing a notice of
`appeal expires in the event of no appeal.

`Wirtgen does not oppose Caterpillar’s request.

`To the extent the Board wishes to discuss the matter, the parties are available at any time tomorrow except from 4 to 5
`p.m. Eastern.

`Best regards,
`Dave
