`Pursuant to Protective Order [D.I. 16] ¶ 7(c) and the Court’s December 22, 2017 Order
`
`regarding scheduling, as well as paragraph 4(c) of the Delaware Default Standard for Discovery,
`
`Including Discovery of Electronically Stored Information (“ESI”), Plaintiff Implicit, LLC
`
`(“Implicit”) hereby makes the following disclosures of infringement contentions for United States
`
`Patent Nos. 7,391,791 (the “’791 patent”) and 8,942,252 (the “’252 patent”) (collectively, the
`
`“Asserted Patents”) regarding Defendant Sonos, Inc. (“Defendant”) and the offerings accused
`
`herein. Implicit’s investigation is ongoing, Implicit has received only core technical discovery
`
`from Defendants, and claim construction has yet to occur. Accordingly, these disclosures are
`
`based on information available to Implicit at this time, and are made without prejudice to Implicit’s
`
`right to supplement or amend these disclosures as Implicit obtains additional information, receives
`
`additional technical discovery from Defendant, and/or claims are construed. Implicit also reserves
`
`the right to find alternative literal and/or equivalent infringing elements in Defendant’s accused
`
`products.

`INITIAL CLAIM CHARTS
`
`Attached hereto at Exhibits A–B are Implicit’s initial claim charts relating to the Accused
`
`Instrumentalities. Any citations in these disclosures are exemplary and not exhaustive, as are the
`
`

`examples provided of the ways in which the Accused Instrumentalities satisfy the elements of each

`Asserted Claim. Moreover, any and all citations or references to documentation should be
`
`understood to encompass any and all prior or later editions and versions that incorporate, describe,
`
`and/or relate to the same or similar functionality. The exemplary proof submitted in these
`
`disclosures is representative of the manner in which the Accused Instrumentalities infringe the
`
`Asserted Claims. The Accused Instrumentalities infringe the Asserted Claims as shown in these
`
`disclosures, regardless of the particular exemplary proof provided.
`
`Furthermore, by identifying in the attached claim charts exemplary evidence of where a
`
`limitation of an Asserted Claim may be found in an Accused Instrumentality, Implicit may address
`
`a range of potential claim constructions of such limitation, including constructions with which
`
`Implicit may disagree.
`
`Finally, Implicit has received only core technical discovery from Defendant, and has not
`
`yet received full discovery regarding the structure, function, or operation of the Accused
`
`Instrumentalities. Such discovery may provide additional details regarding the Accused
`
`Instrumentalities, and Implicit reserves the right to supplement these disclosures upon such
`
`discovery.

`Implicit expressly reserves its right to seek leave of Court to amend or supplement this
`
`disclosure after discovery from Defendant or as permitted under the applicable rules or by the
`
`Court. Implicit further reserves the right to supplement these disclosures to allege infringement
`
`under the doctrine of equivalents if it is found that the Accused Instrumentalities do not literally
`
`meet or practice a particular claim element for any of the claims.
