`There are critical aspects of your stated request that are unaddressed, such as basis, timing and
`briefing length.  I can make availability to have a discussion tomorrow morning.

`In addition, we should discuss the fact that the exhibits and material you’re identifying are primarily
`composed of Petitioner’s own publications – those publications expressly contradict arguments that
`were advanced in Petitioner’s Reply materials.  Such references should have been disclosed to us
`(see 37 CFR 42.51(b)(1)(iii))—but never were disclosed to us (and possibly withheld from your own
`witness)—and certainly should be of record in these proceedings so that the Board can assess the
`credibility of Petitioner’s witness and the Reply arguments. 
`
`It is also appropriate that Patent Owner be accorded corresponding briefing in a motion for the
`appropriate sanctions (e.g., 37 CFR 42.12(a)(1)-(3), (6)) for Petitioner’s failure to comply with
`discovery requirements and the corresponding frivolous/misleading argument in the Reply
`materials.  Additionally, if Petitioner is authorized to file a motion to strike, Patent Owner should be
`authorized to file an opposition to that motion.

`state whether you oppose/do not oppose Patent Owner’s requested briefing.

`patent not previously referenced (Examples 7-11) at 19-22, and other discussions of new references
`with regard to cationic lipid content at 27-29.  Please let me know if Patent Owner opposes this

`email seeking authorization to file replacement exhibits for these, and asking that those originally
`filed be expunged.  Obviously, you can note we don’t oppose the replacement.
