`REVISED JOINT CLAIM CONSTRUCTION CHART
`
`Pursuant to Paragraph 12 of the Scheduling Order in this case (D.I. 26) and the Court’s
`
`Oral Order of February 6, 2018, Plaintiff Fraunhofer and Defendant Sirius XM hereby provide the
`
`following Revised Joint Claim Construction Chart identifying fourteen disputed claim terms to be
`
`addressed at the April 4, 2018 Markman scheduled in this case, plus a number of agreed terms.
`
`The parties incorporate by reference the preliminary statements included in their original Joint
`
`Claim Construction Chart (D.I. 102). The parties further reserve the right, pursuant to the Court’s
`
`Oral Order of February 6, 2018, to “revisit and consider another wave of construction at a time
`
`subsequent to this Markman hearing on April 4th.” Feb. 6, 2018 Tr. at 25:19-21.

`
`OTHER ISSUES
`
`Plaintiff Fraunhofer further requests that the Court correct the following obvious
`
`typographical errors in the claims:
`
`
`
`
`
`’1084 Patent, claim 9: “multi-cattier” should be corrected to “multi-carrier.”
`
`’997 Patent, claim 7: “low path filter” should be corrected to “low pass filter.”
`
`See I.T.S. Rubber Co. v. Essex Rubber Co., 272 U.S. 429 (1926); CBT Flint Partners, LLC v.
`
`Return Path, Inc., 654 F. 3d 1353, 1358 (Fed. Cir. 2011) (“It is well-settled law that, in a patent
`
`infringement suit, a district court may correct an obvious error in a patent claim.”) (citing Essex);
`
`see also ’997 Patent at 10:1-6, Fig. 6.
`
`Sirius XM does not object to Fraunhofer correcting the alleged error identified above in
`
`claim 9 of the ’1084 patent. Sirius XM objects to the alleged error identified above in claim 7 of
`
`the ’997 patent because “low path filter” is not an obvious typographical error.
