`
`
` 1 JUDGE FISHMAN: This is Judge
`
` 2 Fishman. This is a conference call
`
` 3 regarding IPR 2018-00226, 234, and 401.
`
` 4 We have Judge Boudreau on the line, I
`
` 5 believe Judge Siu is unavailable for the
`
` 6 call.
`
` 7 Can we first get a quick roll
`
` 8 call. Who is on the line for petitioner?
`
` 9 MR. STEPHENS: Good afternoon,
`
`10 Your Honor, Garland Stephens from Weil,
`
`11 Gotshal & Manges representing petitioner,
`
`12 Intel Corporation.
`
`13 JUDGE FISHMAN: Anyone else
`
`14 with you for petitioner?
`
`15 MR. COX: This is Brady Cox
`
`16 with Alston & Bird for petitioner Dell.
`
`17 MS. KHACHATOURIAN: And Karineh
`
`18 Khachatourian for petitioner Cavium.
`
`19 JUDGE FISHMAN: And for patent
`
`20 owner?
`
`21 - - -
`
`22 (No response.)
`

`
`24 JUDGE FISHMAN: Anyone on the

`
` 2 - - -
`
` 3 (No response.)
`
` 4 - - -
`
` 5 JUDGE FISHMAN: The petitioner,
`
` 6 Mr. Stephens, do you know, was patent
`
` 7 owner planning on attending, did you have
`
` 8 any feedback from them?
`
` 9 MR. STEPHENS: I don't believe
`
`10 that I saw any feedback from them. I'm a
`
`11 little surprised that they haven't
`
`12 joined, but I don't know any more than
`
`13 that.
`
`14 JUDGE FISHMAN: Let's give it a
`
`15 moment or two.
`
`16 Did you happen to engage a
`
`17 court reporter, by any chance?
`
`18 MR. STEPHENS: There is a court
`
`19 reporter on the line.
`
`20 JUDGE FISHMAN: Okay. Let's
`
`21 get a transcript of the call as soon as
`
`22 possible.
`
`23 MR. STEPHENS: Okay.
`
`24 JUDGE FISHMAN: Let's give it
`

`
`
`
`Hearing - October 18, 2019
`
`5
`
`
` 1 another minute or two to see if anybody
`
` 2 is joining.
`
` 3 MR. STEPHENS: Sure.
`
` 4 JUDGE FISHMAN: I'm going to go
`
` 5 ahead and mute my mike here.
`
` 6 - - -
`
` 7 JUDGE FISHMAN: Haven't heard
`
` 8 anyone else join. Is there anyone on the
`
` 9 call for patent owner?
`
`10 - - -
`
`11 (No response.)
`
`12 - - -
`
`13 JUDGE FISHMAN: Apparently not.
`
`14 We don't like to have any ex-parte
`
`15 communications, so let's not discuss any
`
`16 major substance here. We'd like to
`
`17 reschedule the call, looking at the
`
`18 panel's availability at the moment.
`
`19 Is next Tuesday afternoon open
`
`20 for counsel?
`
`21 MR. COX: Your Honor, I have a
`
`22 Markman hearing on that day at the ITC.
`
`23 JUDGE FISHMAN: Okay. Let me
`
`24 leave the date open for now. We'll send
`
`www.LexitasLegal.com/Premier Lexitas 888-267-1200
`
`
`
`Hearing - October 18, 2019
`
`6
`
`
` 1 a new email out requesting the parties
`
` 2 identify some times that will work.
`
` 3 But without getting into any
`
` 4 major substance, one issue that was
`
` 5 raised in the request for this had to do
`
` 6 with extending a date deadline for
`
` 7 motions to respond until, I'm quoting,
`
` 8 "after any Federal Circuit appeals become
`
` 9 final."
`
`10 To our knowledge there has been
`
`11 no appeal on any of these three cases.
`
`12 I'm not asking you to divulge any
`
`13 strategy, but is that still the case?
`
`14 Are we missing any information here? I
`
`15 don't believe the deadline has expired,
`
`16 but is there a plan to appeal or you
`
`17 don't care to divulge that?
`
`18 MR. STEPHENS: Your Honor, we
`
`19 are still contemplating whether or not to
`
`20 file an appeal. As I'm sure you're
`
`21 probably aware, there's, you know,
`
`22 ongoing developments about the
`
`23 appealability of rulings of this kind.
`
`24 And so we have not reached a definitive
`
`www.LexitasLegal.com/Premier Lexitas 888-267-1200
`
`
`
`Hearing - October 18, 2019
`
`7
`
`
` 1 decision whether to do it or not.
`
` 2 But, as you noted, the time to
`
` 3 file the Notice of Appeal is not yet
`
` 4 expired, so we do want to maintain that
`
` 5 option. And perhaps we should have
`
` 6 indicated in the email that my colleague,
`
` 7 Melissa Hotze sent, that the time to file
`
` 8 a Motion to Expunge could expire a short
`
` 9 time after the Notice of Appeal would be
`
`10 due, if none is filed.
`
`11 JUDGE FISHMAN: Okay, that's
`
`12 fine. I just wanted to confirm that we
`
`13 weren't missing something and you had
`
`14 already filed.
`
`15 So your email is intended to be
`
`16 directed at appeals that Intel may file
`
`17 or petitioners here may file but have not
`
`18 yet decided.
`
`19 MR. STEPHENS: That's correct.
`
`20 JUDGE FISHMAN: That's what you
`
`21 were referring to, okay. I wasn't sure
`
`22 if there was some other appeal that was
`
`23 being referred to.
`
`24 Okay. We will try and organize
`
`www.LexitasLegal.com/Premier Lexitas 888-267-1200
`
`
`
`Hearing - October 18, 2019
`
`8
`
`
` 1 another phone call for some point next
`
` 2 week, see if we can get some dates from
`
` 3 both parties that will work. Not sure if
`
` 4 something happened on our end to
`
` 5 miscommunicate with patent owner.
`
` 6 MR. PAUNOVICH: I apologize,
`
` 7 Your Honor, this is Joe Paunovich, I
`
` 8 joined just a moment ago, I didn't want
`
` 9 to interrupt. I apologize for being
`
`10 late, but I am here on behalf of
`
`11 Alacritech, patent owner. So I'm happy
`
`12 to address any issues or questions that
`
`13 you have for us.
`
`14 JUDGE FISHMAN: Okay, good
`
`15 enough. Let's move ahead. If you may
`
`16 have heard, we just asked one question
`
`17 and that was confirming our understanding
`
`18 that no appeal has yet been filed,
`
`19 petitioners apparently are considering
`
`20 whether or not to file an appeal. The
`
`21 question was really directed to the email
`
`22 that requested this phone call mentions
`
`23 appeals and we were concerned if there
`
`24 was some other appeal that was being
`
`www.LexitasLegal.com/Premier Lexitas 888-267-1200
`
`
`
`Hearing - October 18, 2019
`
`9
`
`
` 1 addressed.
`
` 2 So we understand that the
`
` 3 appeal of concern is potential for
`
` 4 appeals on these three case. So that
`
` 5 said, that pretty much covers everything
`
` 6 we just discussed.
`
` 7 So let's move ahead with
`
` 8 petitioner. Your request for the phone
`
` 9 call was regarding extending the deadline
`
`10 for Motions to Expunge. If you would
`
`11 like to explain what you're looking for
`
`12 and the duration of any such motion,
`
`13 let's proceed.
`
`14 MR. STEPHENS: Yes, Your Honor,
`
`15 thank you. Again, Garland Stephens for
`
`16 petitioner Intel Corporation.
`
`17 Petitioner requests that the
`
`18 deadline to file a motion to expunge be
`
`19 extended to 45 days after any appeals
`
`20 filed in this case are final, or, in the
`
`21 alternative, 45 days after the expiration
`
`22 of the time for filing of a Notice of
`
`23 Appeal in case of no appeal actually
`
`24 filed.
`
`www.LexitasLegal.com/Premier Lexitas 888-267-1200
`
`
`
`Hearing - October 18, 2019
`
`10
`
`
` 1 That is similar to relief
`
` 2 that's been granted in other IPRs by the
`
` 3 board. I can give you one example,
`
` 4 Sanofi versus Immunex, we have IPR
`
` 5 2017-01879, Document 90. And we knew
`
` 6 that -- we anticipate filing a Motion to
`
` 7 Expunge at the conclusion of all the
`
` 8 proceedings for some of the commercially
`
` 9 sensitive material that's in the record
`
`10 and wanted to preserve the ability to do
`
`11 that, and yet still preserve the ability
`
`12 for the record to be intact for any
`
`13 potential appeals.
`
`14 JUDGE FISHMAN: Okay. Patent
`
`15 owner, any comment?
`
`16 MR. PAUNOVICH: We don't oppose
`
`17 the extension of time to file the Motion
`
`18 to Expunge, but want to just make sure
`
`19 it's clear that we would reserve the
`
`20 right to oppose that motion or motions if
`
`21 they are filed.
`
`22 JUDGE FISHMAN: Okay. Just to
`
`23 clarify, Petitioner, you're referring to
`
`24 a Motion to Expunge as opposed to the
`
`www.LexitasLegal.com/Premier Lexitas 888-267-1200
`
`
`
`Hearing - October 18, 2019
`
`11
`
`
` 1 documents becoming public.
`
` 2 At the moment everything has
`
` 3 been sealed. We have not yet addressed
`
` 4 all the motions to seal. To be honest,
`
` 5 we delayed on that for a couple of
`
` 6 reasons. Without getting into details,
`
` 7 we have some concerns, some question
`
` 8 about some of the redactions that were
`
` 9 proposed with regard to the
`
`10 indemnification arrangements. It is
`
`11 public record, to our knowledge, that an
`
`12 indemnification agreement exists. And
`
`13 it's public knowledge that there was
`
`14 intervention based at least in part on
`
`15 that indemnification. That was part of
`
`16 the basis for us to drag our feet, to be
`
`17 honest, on motions to seal.
`
`18 Is it your intention that the
`
`19 Motion to Expunge would be in the
`
`20 alternative to maintaining the seal and
`
`21 rather eliminating these documents?
`
`22 MR. STEPHENS: I believe that's
`
`23 correct, Your Honor, at least once the
`
`24 proceedings are complete, that we would
`
`www.LexitasLegal.com/Premier Lexitas 888-267-1200
`
`
`
`Hearing - October 18, 2019
`
`12
`
`
` 1 move to expunge the documents that
`
` 2 hopefully will have been sealed up to
`
` 3 that point.
`
` 4 JUDGE FISHMAN: Okay. And,
`
` 5 again, to clarify, your suggestion would
`
` 6 be 45 days after the deadline for appeal
`
` 7 is passed, if you choose not to appeal,
`
` 8 which would be roughly 45 days plus a
`
` 9 week or so, I forget exactly what the
`
`10 deadline is right now.
`
`11 MR. STEPHENS: Yes. I believe
`
`12 it's coming up fairly soon, so I think
`
`13 that's correct. I don't recall the exact
`
`14 deadline either, Your Honor, but I know
`
`15 it hasn't passed yet and it's coming up
`
`16 fairly soon.
`
`17 JUDGE FISHMAN: Okay. Or, in
`
`18 the alternative, if you do file appeals,
`
`19 you want to extend that deadline for
`
`20 expungement until after the Federal
`
`21 Circuit has ruled. Does that mean ruled
`
`22 and after your request for a rehearing,
`
`23 if you lose? What would be the deadline
`
`24 you're seeking if you do decide to file
`
`www.LexitasLegal.com/Premier Lexitas 888-267-1200
`
`
`
`Hearing - October 18, 2019
`
`13
`
`
` 1 an appeal?
`
` 2 MR. STEPHENS: Once the appeal
`
` 3 becomes final, you know, it's difficult
`
` 4 at this time to anticipate all of the
`
` 5 potential administrative activities, but
`
` 6 once 45 days after the appeal becomes
`
` 7 final is what we had in mind.
`
` 8 MR. PAUNOVICH: So would that
`
` 9 be the mandate, the issuance of the
`
`10 mandate, 45 days?
`
`11 MR. STEPHENS: Again, after the
`
`12 appeal becomes final, so after any
`
`13 ability to file a motion for a hearing on
`
`14 bond or a petition for certiorari.
`
`15 JUDGE FISHMAN: If there were a
`
`16 mandate, the mandate could follow beyond
`
`17 that?
`
`18 MR. STEPHENS: I'm not an
`
`19 expert on administrative procedure post
`
`20 Federal Circuit appeals, so I can't say
`
`21 precisely what the specific
`
`22 administrative action that would result
`
`23 in the deal being final is, off the top
`
`24 of my head. But that's what we have in
`
`www.LexitasLegal.com/Premier Lexitas 888-267-1200
`
`
`
`Hearing - October 18, 2019
`
`14
`
`
` 1 mind, once the appeal becomes final, that
`
` 2 we'd have some reasonable period to file
`
` 3 a Motion to Expunge.
`
` 4 JUDGE FISHMAN: Okay. I have
`
` 5 not yet heard that I'm going to be
`
` 6 appointed to the Federal Circuit, so.
`
` 7 MR. STEPHENS: I apologize for
`
` 8 not researching that, but the basic
`
` 9 notion here is fairly simple. And if you
`
`10 want something more precise, then simply
`
`11 that the appeal becomes final or the
`
`12 Notice of Appeal deadline has passed
`
`13 without a notice being filed, we can
`
`14 propose something. I'd have to research
`
`15 that a little bit.
`
`16 JUDGE FISHMAN: Okay. Let me
`
`17 leave the phone briefly and confer with
`
`18 my colleagues.
`
`19 - - -
`
`20 JUDGE FISHMAN: Okay. We are
`
`21 going to authorize a brief motion
`
`22 requesting extension. We will
`
`23 temporarily extend the time in a short
`
`24 order that we'll issue in the next day or
`
`www.LexitasLegal.com/Premier Lexitas 888-267-1200
`
`
`
`Hearing - October 18, 2019
`
`15
`
`
` 1 so. We will extend the time at least as
`
` 2 long as it takes us to decide on this
`
` 3 motion. So we will authorize a brief
`
` 4 motion for petitioner. If there is an
`
` 5 opposition, we'll have a brief opposition
`
` 6 authorized. I would like to think this
`
` 7 is a very brief and simple issue to
`
` 8 discuss.
`
` 9 Petitioner, would you be good
`
`10 with no more than five pages and let's
`
`11 say by, let's see, Wednesday, the 23rd?
`
`12 MR. STEPHENS: Yes, that's
`
`13 fine. And also we will run it by the
`
`14 patent owner before we file, so hopefully
`
`15 we can file something that's not opposed.
`
`16 JUDGE FISHMAN: That would be
`
`17 great. If there is an opposition, patent
`
`18 owner, would similar five pages and
`
`19 Monday, the 28th, be workable?
`
`20 MR. PAUNOVICH: Yes, that would
`
`21 be fine, Your Honor.
`
`22 JUDGE FISHMAN: Okay. I'd like
`
`23 to think we don't need a reply to the
`
`24 opposition. I would like to think this
`

`
`
`
`Hearing - October 18, 2019
`
`16
`
`
` 1 is a simple matter to discuss in brief.
`
` 2 Does that work for everyone?
`
` 3 MR. STEPHENS: Yes, Your Honor.
`
` 4 MR. PAUNOVICH: Yes, Your
`
` 5 Honor.
`
` 6 JUDGE FISHMAN: Okay. Go
`
` 7 ahead. Please get a transcript of the
`
` 8 call filed as soon as possible. We will
`
` 9 issue a brief order to this effect,
`
`10 probably won't get out today, but we'll
`
`11 get it out early next week. But you can
`
`12 presume this authorization will be
`
`13 granted.
`
`14 Anything else, Mr. Paunovich?
`
`15 MR. PAUNOVICH: No, Your Honor.
`
`16 Thank you very much.
`
`17 JUDGE FISHMAN: Okay. Thank
`
`18 you all, and have a good day.
