` 8 "after any Federal Circuit appeals become

`10 To our knowledge there has been

`11 no appeal on any of these three cases.

`12 I'm not asking you to divulge any
`
`13 strategy, but is that still the case?
`
`14 Are we missing any information here? I
`
`15 don't believe the deadline has expired,
`
`16 but is there a plan to appeal or you
`
`17 don't care to divulge that?
`
`18 MR. STEPHENS: Your Honor, we

`19 are still contemplating whether or not to
`
`20 file an appeal. As I'm sure you're
`
`21 probably aware, there's, you know,

`22 ongoing developments about the
`
`23 appealability of rulings of this kind.

` 2 But, as you noted, the time to

` 6 indicated in the email that my colleague,

` 7 Melissa Hotze sent, that the time to file
`
` 8 a Motion to Expunge could expire a short
`
` 9 time after the Notice of Appeal would be
`
`10 due, if none is filed.
`
`11 JUDGE FISHMAN: Okay, that's
`
`12 fine. I just wanted to confirm that we
`
`13 weren't missing something and you had
`
`14 already filed.

`15 So your email is intended to be
`
`16 directed at appeals that Intel may file
`
`17 or petitioners here may file but have not
`
`18 yet decided.

`11 Alacritech, patent owner. So I'm happy

`12 to address any issues or questions that
`
`13 you have for us.

`15 enough. Let's move ahead. If you may
`
`16 have heard, we just asked one question
`
`17 and that was confirming our understanding
`
`18 that no appeal has yet been filed,
`
`19 petitioners apparently are considering
`
`20 whether or not to file an appeal. The
`
`21 question was really directed to the email
`
`22 that requested this phone call mentions
`
`23 appeals and we were concerned if there
`
`24 was some other appeal that was being
`

` 2 So we understand that the
`
` 3 appeal of concern is potential for
`
` 4 appeals on these three case. So that
`
` 5 said, that pretty much covers everything
`
` 6 we just discussed.

` 7 So let's move ahead with

` 8 petitioner. Your request for the phone
`
` 9 call was regarding extending the deadline
`
`10 for Motions to Expunge. If you would
`
`11 like to explain what you're looking for
`
`12 and the duration of any such motion,
`
`13 let's proceed.

`14 MR. STEPHENS: Yes, Your Honor,
`
`15 thank you. Again, Garland Stephens for
`
`16 petitioner Intel Corporation.

`17 Petitioner requests that the
`
`18 deadline to file a motion to expunge be
`
`19 extended to 45 days after any appeals
`
`20 filed in this case are final, or, in the
`
`21 alternative, 45 days after the expiration
`
`22 of the time for filing of a Notice of
`
`23 Appeal in case of no appeal actually
`
`24 filed.

` 2 that's been granted in other IPRs by the
`
` 3 board. I can give you one example,
`
` 4 Sanofi versus Immunex, we have IPR
`
` 5 2017-01879, Document 90. And we knew
`
` 6 that -- we anticipate filing a Motion to
`
` 7 Expunge at the conclusion of all the
`
` 8 proceedings for some of the commercially
`
` 9 sensitive material that's in the record
`
`10 and wanted to preserve the ability to do
`
`11 that, and yet still preserve the ability
`
`12 for the record to be intact for any
`
`13 potential appeals.
`
`14 JUDGE FISHMAN: Okay. Patent
`
`15 owner, any comment?
`
`16 MR. PAUNOVICH: We don't oppose
`
`17 the extension of time to file the Motion
`
`18 to Expunge, but want to just make sure
`
`19 it's clear that we would reserve the
`
`20 right to oppose that motion or motions if
`
`21 they are filed.
`
`22 JUDGE FISHMAN: Okay. Just to
`
`23 clarify, Petitioner, you're referring to
`
`24 a Motion to Expunge as opposed to the
`

` 2 At the moment everything has
`
` 3 been sealed. We have not yet addressed
`
` 4 all the motions to seal. To be honest,
`
` 5 we delayed on that for a couple of
`
` 6 reasons. Without getting into details,
`
` 7 we have some concerns, some question
`
` 8 about some of the redactions that were
`
` 9 proposed with regard to the
`
`10 indemnification arrangements. It is
`
`11 public record, to our knowledge, that an
`
`12 indemnification agreement exists. And
`
`13 it's public knowledge that there was
`
`14 intervention based at least in part on
`
`15 that indemnification. That was part of
`
`16 the basis for us to drag our feet, to be
`
`17 honest, on motions to seal.
`
`18 Is it your intention that the
`
`19 Motion to Expunge would be in the
`
`20 alternative to maintaining the seal and
`
`21 rather eliminating these documents?
`
`22 MR. STEPHENS: I believe that's
`
`23 correct, Your Honor, at least once the
`
`24 proceedings are complete, that we would
`

` 1 move to expunge the documents that
`
` 2 hopefully will have been sealed up to
`
` 3 that point.

` 4 JUDGE FISHMAN: Okay. And,
`
` 5 again, to clarify, your suggestion would
`
` 6 be 45 days after the deadline for appeal
`
` 7 is passed, if you choose not to appeal,
`
` 8 which would be roughly 45 days plus a
`
` 9 week or so, I forget exactly what the
`
`10 deadline is right now.
`
`11 MR. STEPHENS: Yes. I believe
`
`12 it's coming up fairly soon, so I think
`
`13 that's correct. I don't recall the exact
`
`14 deadline either, Your Honor, but I know
`
`15 it hasn't passed yet and it's coming up
`
`16 fairly soon.
`
`17 JUDGE FISHMAN: Okay. Or, in
`
`18 the alternative, if you do file appeals,
`
`19 you want to extend that deadline for
`
`20 expungement until after the Federal
`
`21 Circuit has ruled. Does that mean ruled
`
`22 and after your request for a rehearing,
`
`23 if you lose? What would be the deadline
`
`24 you're seeking if you do decide to file
`

` 3 becomes final, you know, it's difficult
`
` 4 at this time to anticipate all of the
`
` 5 potential administrative activities, but
`
` 6 once 45 days after the appeal becomes
`
` 7 final is what we had in mind.
`
` 8 MR. PAUNOVICH: So would that
`
` 9 be the mandate, the issuance of the
`
`10 mandate, 45 days?
`
`11 MR. STEPHENS: Again, after the
`
`12 appeal becomes final, so after any
`
`13 ability to file a motion for a hearing on
`
`14 bond or a petition for certiorari.
`
`15 JUDGE FISHMAN: If there were a
`
`16 mandate, the mandate could follow beyond
`
`17 that?
`
`18 MR. STEPHENS: I'm not an
`
`19 expert on administrative procedure post
`
`20 Federal Circuit appeals, so I can't say
`
`21 precisely what the specific
`
`22 administrative action that would result
`
`23 in the deal being final is, off the top
`
`24 of my head. But that's what we have in

` 2 we'd have some reasonable period to file
`

` 6 appointed to the Federal Circuit, so.
`
` 7 MR. STEPHENS: I apologize for
`
` 8 not researching that, but the basic
`
` 9 notion here is fairly simple. And if you
`
`10 want something more precise, then simply

`11 that the appeal becomes final or the
`
`12 Notice of Appeal deadline has passed
`
`13 without a notice being filed, we can
`
`14 propose something. I'd have to research
`
`15 that a little bit.
