`entitled “Method and Device for Receiving and Providing Programs,” filed on August 9, 2005,

`and issued on August 21, 2012 as US. Patent No. 8,249,114, which patent claims priority as a
`
`non-provisional of US. Provisional Patent Application Serial No. 60/600,473 filed on August 10,
`
`2004, and also claims priority as a non-provisional of US. Provisional Patent Application Serial
`
`No. 60/662,844, filed on March 18, 2005, entitled "Switched Broadcast Implementation," the
`
`entire disclosures of each of these applications are hereby incorporated by reference in their
`
`entirety.

`This Preliminary Amendment is made to provide notification of priority on in the first
`
`line of the application. No new matter has been added with this amendment.
`
`Moreover, Assignee respectfully notes for the Examiner that the claims for this
`
`continuation have been copied from United States Patent No. 8,464,299 (‘299 Patent), entitled
`
`“Resource conservation for packet television services,” which issued on June 11, 2013, and was
`
`originally assigned to “Nortel Networks,” but the face of the ‘299 Patent identifies it as assigned
`
`to “Rockstar Consortium US LP.” Assignee respectfully assert that these copied claims provide
`
`the basis for declaration of an interference between the current application and the ‘299 Patent.
`
`Assignee respectfully asserts that the subject matter of the claims that issued on the ‘299
`
`Patent are disclosed by US. Provisional Patent Application Serial No. 60/600,473, filed August
`
`10, 2004, to which the present application claims priority. This ‘299 Patent claims its earliest
`
`priority to US. Provisional Applications 60/628,577 and 60/628,625, both filed on November
`
`17, 2004. On the basis of the earlier priority claim of the current application, the Assignee of the
`
`current application should be afforded the title “Senior Party” in any subsequent interference
`
`declared between the current application and the ‘299 Patent.
`
`No fees are believed due with this Amendment. In the event that any fees are deemed
`
`due by the Assignee or credits owed to the Assignee, please apply any such charges or credits to
`
`deposit account 01-2125.
