`Petitioner’s Motion to Expunge Confidential Information
`37 C.F.R. § 42.56
`
`
`

`

`IPR2018-00067
`Patent 8,577,813 B2
`
`
`
`I. PETITIONER’S MOTION TO EXPUNGE
`Petitioner moves unopposed to expunge certain confidential
`information in the record: Papers 28, 39, 48, 49, and 54, and Exhibits 1036,
`1037, 2011, 2012, and 2017. Paper 60 (“Motion”).
`Other than the Final Written Decision (Paper 54), each of the items
`Petitioner seeks to expunge was the subject of Petitioner’s Motion to Seal
`(Paper 55), which we granted. See Paper 58. Because the confidential
`information in these documents may facilitate any eventual review by the
`U.S. Court of Appeals for the Federal Circuit, it would be premature to
`expunge the documents at this time. We consider a motion to expunge
`appropriate to remove documents from the record that were filed with
`restricted access, but not subject to a successful motion to seal and not relied
`on in a decision of the Board. That is not the case for the documents here.
`The documents identified above, including our Final Written Decision, will
`remain under seal.
`
`II. ORDER
`
`It is therefore
`ORDERED that Petitioner’s Motion to Expunge is denied.
