`I am currently a Professor in the Department of Library and
`
`Information Science at the Catholic University of America. I have experience
`
`working in an academic library, a medical library, and a legislative library and
`
`have been a professor for 27 years. I hold a Ph.D. in Library and Information
`
`Studies from the University of Wisconsin-Madison and a Masters in Library and
`
`Information Studies from the University of Wisconsin-Madison.

`I am an expert on library cataloging and classification and have
`
`published two books on this subject, Organizing Audiovisual and Electronic
`
`Resources for Access: A Cataloging Guide (2000, 2006). I teach a variety of
`
`courses in the area of information organization and access, including “Cataloging
`
`and Classification,” “Advanced Cataloging and Classification,” “Organization of
`
`Internet Resources,” “Internet Searches and Web Design,” “Advanced Information
`
`Retrieval and Analysis Strategies,” “Digital Content Creation and Management,”
`
`and “Information Literacy Instruction.” My research interests cover cataloging and
`
`classification, information organization, metadata, information retrieval,
`
`information architecture, digital collections, scholarly communication, digital
`
`scholarship, data management, user interaction with information systems, and
`
`others.

`I am fully familiar with a library cataloging encoding standard known
`

`as the “Machine-Readable Cataloging” standards, also known as “MARC.” The
`
`standards were developed by Henriette Avram in the 1960s for libraries to create
`
`and share bibliographic records. MARC became the national standard for sharing
`
`bibliographic data in the United States by 1971 and the international standard by
`
`1973. It is the primary metadata transmission standard for the transfer and storage
`
`of bibliographic metadata in libraries. Experts in my field would reasonably rely
`
`upon MARC records when forming their opinions.
`

`The MARC standards define the field designation, structure and
`
`content designation of MARC records. A MARC bibliographic record consists of
`
`fields, and each field provides specific information, such as author, about the item
`
`represented by the record. MARC uses a simple three-digit numeric code to
`
`identify each field, and most fields have field-specific indicators and subfields.
`
`Appendix B is a copy of Parts 7 to 10 of “Understanding MARC Bibliographic”
`
`(http://www.loc.gov/marc/umb/) from the Library of Congress that explains
`
`commonly used MARC fields. For example, the personal author of a publication is
`
`recorded in Field 100, the title is recorded in Field 245, information about the place
`
`of publication and publisher is recorded in Field 260, the physical format and
`
`characteristics of a publication are recorded in Field 300, and topical information is
`
`

`10. Online Computer Library Center (OCLC) is a global nonprofit library
`
`cooperative that manages the largest bibliographic network of the world, with more
`
`than 380 million records and 16,131 member institutions (many of which are
`
`libraries of some type) in 120 countries. OCLC was created “to establish, maintain
`
`and operate a computerized library network and to promote the evolution of library
`
`use, of libraries themselves, and of librarianship, and to provide processes and
`
`products for the benefit of library users and libraries, including such objectives as
`
`increasing availability of library resources to individual library patrons and
`
`reducing the rate of rise of library per-unit costs, all for the fundamental public
`
`purpose of furthering ease of access to and use of the ever-expanding body of
`
`worldwide scientific, literary and educational knowledge and information.”1
`
`11. OCLC members can contribute original cataloging records in MARC
`
`to the bibliographic network or derive cataloging records from existing records, an
`
`activity referred to as “copy cataloging.” When an OCLC participating institution
`
`acquires a work, it can create an original MARC record for this work in OCLC’s
`
`

`Connexion system (a cataloging system), and the system will automatically
`
`generate a code for the date of record creation in the yymmdd format, and the
`
`creating library’s OCLC symbol is recorded in subfield a of Field 040. Once the
`
`MARC record is in Connexion, it becomes available to other OCLC members for
`
`adoption to their local online catalogs. The record—presented in a labeled format,
`
`not MARC—also becomes searchable and viewable on WorldCat, which is a web
`
`portal to more than 10,000 libraries worldwide.
`
`12. Library online catalogs are based on MARC records that represent
`
`their collections to help the public understand what materials are publicly
`
`accessible in those libraries. Most libraries with online catalogs have made their
`
`catalogs freely available on the Web. These online catalogs offer user-friendly
`
`search interfaces, often in the form of a single search box, to support searching by
`
`author, title, subject, keywords and other data elements. They also offer features
`
`for users to narrow their search results by language, year, format, and other
`
`elements. Many libraries display MARC records in their online catalogs with
`
`labels for the data elements to help the public interpret MARC records. Many
`
`libraries also offer an option to display MARC records in MARC fields. For
`
`publications such as monographs, after a MARC record is created and made
`
`searchable in a library catalog, it is customary library practice to have the physical
`

`Microsoft Excel 2000 Bible (”Excel”), which I scanned on Oct. 2, 2017 at the

`Library of Congress. Page 5 of EX1009 shows the book was published by “IDG

`Books Worldwide Inc.” of Foster City, California. The copyright date of the book
`
`is 1999. It has a Library of Congress Catalog Card Number “98-75379” and an
`
`ISBN (International Standard Book Number) “0-7645-3259-6.” Page 5 also shows
`
`a date stamp, indicating the copy was received by the Library of Congress
`
`Copyright Office on “Jul 07 1999” (i.e., July 7, 1999). The call number of Copy 2
`
`is “HF5548.4.M523W34589 1999 Copy 2 MRC.” “Copy 2 MRC” indicates this is
`
`copy 2 of this book and it is part of the Machine Readable Collections.

`16. Appendix AAAA is a true and accurate copy of the Bibliographic
`
`Record for “Excel” that I located from the Library of Congress Online Catalog at
`
`https://catalog.loc.gov on Sept. 25, 2017. I personally identified and located this
`
`record, which experts in my field would reasonably rely upon when forming their
`
`opinion. The publisher information on page 1 of Appendix AAAA and the ISBN
`
`and LCCN (Library of Congress Catalog Card Number) fields on page 2 match the
`
`information on EX1009, confirming the Bibliographic Record is a true record for
`
`this publication. The bottom of page 2 indicates the call number of this book is
`
`“HF5548.4.M523 W34578 1999,” Copy 2 is stored offsite at Fort Meade, and the
`
`book can be requested in “Machine Readable Collections” of the Library of

`“Excel” that I located from the Library of Congress Online Catalog at
`
`https://catalog.loc.gov. I personally identified and located this record, which
`
`experts in my field would reasonably rely upon when forming their opinion. Field
`
`008 of Appendix BBBB shows the record was first created on “981016” (i.e.,
`
`October 16, 1998). Subfield a of Field 040 identifies the library contributing this
`
`original record as “NNF,” the library code of the Middlesex County College
`
`Library in Edison, New Jersey, according to the Directory of OCLC Members
`
`(http://www.oclc.org/en/contacts/libraries.html). Subfield d of Field 040 indicates
`
`“DLC” (the library code of the Library of Congress) modified the original record,
`
`and Field 042, the field for authentication code, identifies the revised record as
`
`“lccopycat.” This means Appendix BBBB is a copy cataloging record based on the

`NNF record. Field 955 shows the timeline of record creation and editing at the

`Library of Congress. It shows a copy of the book was sent to the cataloging unit on

`the processing was completed. All libraries are committed to making new materials
`
`accessible to the public as soon as possible. Most academic libraries make books
`
`available soon after MARC records are searchable in their online catalogs, usually
`
`within a week. The volume of materials to process at the Library of Congress
`
`means BCCD may take more than a week to finish processing the physical item,
`
`but it is unlikely to take more than 60 days. In the case of Copy 2, because adding
`
`a copy does not require the creation of a new bibliographic record, the physical
`
`volume would have been sent to BCCD on the date specified (i.e., October 26,
`
`1999) and became publicly accessible soon after that date.
`
`18. Field 245 identifies the title of the publication as “Microsoft Excel
`
`2000 Bible” and the author as “John Walkenbach.” Field 260 shows this book was
`
`published in Foster City, CA by “IDG Books Worldwide” and the copyright date is
`
`“1999.” Field 300 indicates the book has 936 pages and includes “1 computer laser
`
`optical disc,” i.e., CD-ROM. The first Field 500 provides a note indicating the
`
`book is accompanied by “Microsoft Excel 2000 bible Quick Start” which has 22
`
`numbered pages with additional pages. The cover of “Excel” (EX1009) shows it
`
`includes “bonus 32-page Quick Start book.” The number of pages in Field 500 is
`
`different from 32 because the cataloging practice is to record the number on the

`
`classification number for Microsoft Excel and “W34578” is the author number for
`
`“Walkenbach.” Field 630 shows the subject heading of this book is “Microsoft
`
`Excel (Computer file), and the two topical subject headings in Field 650 show this
`
`book are about “Electronic spreadsheets” and “Business |x Computer programs”
`
`(computer programs for business). This MARC record (Appendix BBBB) makes
`
`this book searchable in the Library of Congress Online Catalog by author, title,
`
`ISBN, and other data elements. Users interested in Microsoft Excel, electronic
`
`spreadsheets or computer programs for business can search for these topics by the
`
`Library of Congress classification number and the subject headings listed in the
`
`630 field and the 650 fields.

`19. Based on the information above, it is my opinion that Microsoft Excel

`2000 Bible (“Excel”) was first cataloged on October 16, 1998 by NNF, and the

`Library of Congress revised that record and identified the revised record as
`
`“lccopycat” in Field 042. The Library of Congress copy cataloging record was
`
`completed on July 27, 1999, and a second copy of the book was added to the

`23. Based on the information above, it is my opinion that Microsoft Excel

`2000 Bible was first cataloged on October 16, 1998 by NNF, the Library of
`
`Congress revised that record and the Library of Congress copy cataloging record
`
`was completed on July 27, 1999. The Wayne State University Library then used
`
`the “lccopycat” record to create its copy cataloging record on October 1, 1999 and
`
`made the book publicly accessible shortly after, usually within a week in academic
`
`libraries.

`24. Taken together, the Library of Congress date stamp and records
`
`support my opinion that Microsoft Excel 2000 Bible by John Walkenbach
`
`(EX1009) was publicly accessible as early as July 27, 1999 when the Library of
`
`Congress copy cataloging record was completed and no later than Oct. 26, 1999
`
`when Copy 2 was added to the Library of Congress collection. The processing time
`
`for preparing books for public access at the Library of Congress may take some
`
`time, but it is very likely this book would be publicly accessible no later than
`
`December of 1999 at the Library of Congress.

`25. The Wayne State University Library records support my opinion that
