`
`MODIFYING SCHEDULING ORDER
`37 C.F.R. § 42.5
`
`
`
`
`

`
` This Order addresses issues common to each captioned cases. Thus, we
`enter the same Order in each case.

`IPR2017-02020 (Patent 9,249,218 B2)
`
`
`On September 6, 2018, via email correspondence to the Board,
`including Patent Owner, Petitioner requested that we authorize changes to
`DUE DATES 6 and 7 because lead and back-up counsel for Petitioner have
`an unrelated jury trial set to begin between those dates, on November 26,
`2018. Ex. 3001. Specifically, Petitioner seeks to move DUE DATE 6 from
`November 13, 2018, to December 5, 2018, and to move DUE DATE 7 from
`December 4, 2018, to a date in January 2019. Id. In the same
`correspondence, Petitioner notifies us that the request is unopposed by
`Patent Owner. Id.
`
`Based upon the circumstances involved, including the lack of
`opposition by Patent Owner, and the availability of the panel and hearings
`staff to accommodate a new hearing date, Petitioner’s request to change
`DUE DATES 6 and 7 is granted. As stated in the Scheduling Order, Paper
`17, the parties may stipulate to changes of other DUE DATES, so long as
`any changed dates are no later than modified DUE DATE 6.
`
`Accordingly, the Scheduling Order in this proceeding is hereby
`modified as follows:
`
`DUE DATE 6 is changed from November 13, 2018, to December 5,
`
`2018;
`
`DUE DATE 7 is changed from December 4, 2018, to January 10,
`2019.
