`Statement of Precise Relief Requested
`Pursuant to 37 C.F.R. § 42.10(e) Mylan Pharmaceuticals Inc. (“Mylan”)
`
`
`
`hereby respectfully requests that the Patent Trial and Appeal Board (the “Board”)
`
`authorize the withdrawal of Robert D. Swanson, back up counsel in this matter.
`
`Patent Owner has stated it will not oppose this motion. The Board granted
`
`permission to file this motion during a telephonic hearing held on January 24,
`
`2019.
`
`II.
`
`Statement of Facts Showing Good Cause for the Board to Authorize
`Withdrawal
`Under 37 C.F.R. § 42.10(e), counsel may not withdraw from a proceeding
`
`without authorization from the Board. On April 2, 2018, Mylan submitted a pro
`
`hac vice application for Mr. Swanson which was granted by the Board on June 11,
`
`2018 (Paper 39). Mylan then submitted its Updated Mandatory Notices listing Mr.
`
`Swanson as additional back up counsel on June 18, 2018 (Paper 43). Mr. Swanson
`
`is no longer associated with the firm Perkins Coie LLP, therefore Mylan
`
`respectfully requests the Board’s authorization to withdraw Mr. Swanson as an
`
`additional back up counsel in this proceeding. Mylan will continue to be
`
`represented by lead counsel, Brandon M. White, a registered practitioner.
`
`III. Conclusion
`For the foregoing reasons, Mylan respectfully requests that the Board
`
`authorize the withdrawal of Robert D. Swanson in this proceeding.
