`Pursuant to this Court’s Patent Pretrial Order, Plaintiff Prisua Engineering Corp.
`
`(“Prisua”) and Defendants Samsung Electronics Co., Ltd., Samsung Electronics America,
`
`Inc., and Samsung Electronics Latinoamerica Miami, Inc. (collectively “Samsung”)
`
`jointly submit this Joint Claim Construction and Prehearing Statement.
`
`I. Proposed Claim Constructions and Supporting Evidence
`
`Counsel for the parties have met and conferred regarding the submission of this
`
`Joint Claim Construction and Prehearing Statement with regards to U.S. Pat. No.
`
`8,650,591 (the “‘591 patent”).
`
`a. Agreed Constructions
`
`The parties agree on the construction of the following terms:
`
`1. Claim 1 - “performing a substitution.” This term should be assigned its
`
`plain meaning.

`b. Proposed Constructions of Disputed Terms
`
`The parties’ disputed terms and proposed constructions thereof are identified in
`
`Exhibit “A” hereto. Exhibit “A” likewise includes the parties’ identification of intrinsic
`
`and extrinsic evidence in support of the parties’ respective proposed constructions. Each
`
`party reserves the right to supplement or amend its supporting evidence (both intrinsic
`
`and extrinsic) based on newly identified evidence, including but not limited to documents
`
`requested but not yet received from the other party or the presentation of rebuttal
`
`declarations or testimony. In addition, each party reserves the right to rely on any
`
`intrinsic or extrinsic evidence identified by the other party in support of its proposed
`
`constructions.
`
`c. Most Significant Disputed Claim Terms for Construction
`
`The parties jointly identify the following terms of the ‘591 patent as most
`
`significant to resolution of the case:
`
`1. “user input video data stream”
`
`2. “original video data stream”
`
`3. “spatially matching”
`
`The parties agree that the construction of the foregoing terms will be case or claim
`
`dispositive.
`
`In addition, Samsung contends that claims 3 and 4 of the ’591 patent are
`
`indefinite, a finding of which would dispose of those claims.
`
`II. Claim Construction Hearing
`
`The parties anticipate the length of time necessary for the Claim Construction
`
`Hearing is 3.5 hours per side for a total of 7 hours.

`Defendants reserve the right to call Dr. Edward Delp to provide rebuttal expert
`
`testimony at the Claim Construction Hearing should the Court allow expert testimony at
`
`the hearing. Defendants reserve the right to have Dr. Delp testify that a person of
`
`ordinary skill in the art would interpret the claims as asserted by Defendants. Defendants
`
`may rely on Dr. Delp’s opinion in support of its claim construction briefing.
