`
`AFFIDAVIT OF CHRISTOPHER BUTLER
`
`I. I am the Office Manager at the Internet Archive, located in San Francisco,
`California. I make this declaration of my own personal knowledge.
`2. The Internet Archive is a website that provides access to a dig ital library of
`Internet sites and other cultural artifacts in digital form. Like a paper li brary, we provide
`free access to researchers, historians. scholars, and the general public. The Internet
`Archive has partnered with and receives support from various institutions, including the
`Library of Congress.
`3. The Internet Archive has created a service known as the Wayback Machine. The
`Wayback Machine makes it possible to surf more than 450 bill ion pages stored in the
`Internet Archive's web archive. Visitors to the Wayback Machine can search archives
`by URL (i.e., a website address). If archived records for a URL are avai lable, the visitor
`will be presented with a list of avai lable dates. The visitor may select one of those
`dates, and then begin surfing on an archi ved version of the Web. The links on the
`archi ved files, when served by the Wayback Machine, point to other archi ved fil es
`(whether HTML pages or images). If a visitor clicks on a link on an archived page, the
`Wayback Machine will serve the archi ved file with the closest available date to the page
`upon which the link appeared and was cl icked.
`4. The archived data made viewable and browseable by the Wayback Machine is
`compiled using software programs known as crawlers, which surf the Web and
`automatically store copies of web fi les, preserving these files as they exist at the point of
`time of capture.
`5. The Internet Archive assigns a URL on its site to the archived files in the format
`http://web.archi ve.org/web/[Year in yyyy][Month in mm][Day in dd][Time code in
`hh:mm:ss]/[Archived URL] . Thus, the Internet Archive URL
`http://web.archive .org/web/19970 126045828/http://www.archive.org/ would be the
`URL for the record of the Internet Archive home page HTML file
`(http://www.archive.org/) archived on January 26, 1997 at 4:58a.m. and 28 seconds
`( 1997/01 /26 at 04:58:28). A web browser may be set such that a printout from it will
`disp lay the URL of a web page in the printout 's footer. The date ass igned by the Internet
`Archive applies to the HTML file but not to im age files linked therein. Thus images that
`appear on a page may not have been archi ved on the same date as the HTM L fi I e.
`Likewise, if a website is designed with "frames," the date assigned by the Internet
`Archi ve applies to the frameset as a whole, and not the individual pages within each
`frame.
`6. Attached hereto as Exh ibit A are true and accurate copies of screens hots of
`printouts of the Internet Archive's records of the HTML or PDF files for the URLs and
`the dates specified in the attached coversheet to each printout.
`7. I declare under penalty of perjury that the foregoing is true and correct.

`

`MOBILE VIDEO TUTORIAL
`
`How Long Should a Mobile Pod Be?
`A mobile pod should go on for as long as the action is compelling. Current is a short form network though
`so 15 seconds to 10 minutes (you’ll need a video card for video on the longer side, see below) is the general
`range. We are looking for moments, little slices of time, although feel free get crafty and edit many mobile
`moment together into a story.
`
`How long can you shoot video on your phone?
`Every device is different. It could be 15 seconds or a few minutes. Check the specs on your phone. Buying
`memory card will up your recording time to eight hours or so.
`
`What about lighting?
`In general, always try and keep your subject in the light. Mobile cameras have tiny little lenses that don’t let
`in a lot of natural light so if you’re indoors, open the curtains and turn on some lamps. Outdoors things can
`be a little trickier.
`
`Outdoors
`Daytime, with the sun shining, gives the brightest colors, but don’t shoot into the sun. This is true for pretty
`much all cameras, but mobile cameras in particular tend to get overexposed.
`
`Overcast, gray days give an even light. The colors captured may be a somewhat muted.
`
`Nighttime footage will tend to be grainy so try and add a little extra light. Turn on your car headlights,
`maneuver your subject under a streetlamp or open the door of the club and let the light flow out.
`
`How can I get better audio out of my mobile camera?
`The location of the mic on every mobile phone is different. Once you’ve identified where yours is, try and
`shoot with the mic as close to your sound source as possible. If you’re doing an interview and your sound
`isn’t good shoot video of your subject not talking,-- a portrait shot or b-roll -- and then shoot the audio
`separate.
`
`What kind of shots work best for mobile video?
`Keep the camera still. Shaky cam, shaky video. If you want to pan or tilt the camera, do it very slowly. If you
`do it very quickly -- a snap pan -- it will give you a streaky image, which might look cool, it will just lack
`detail
`
`Wide shots will look, well, wide, and even if the footage gets enlarged to go to air, your subjects might seem
`kind of tiny and the shot might not capture what you see. Try to get a variety of shots, including close-ups.

`
`A Pod Is a short video that tells a story, profiles a character and/or shares an idea. Current
`TV Pods are nonfiction videos that are anywhere from one minute to seven or eight minutes;
`it's a self-contained story, a profile of an interesting character or a dose of information. It's

`
`How does the Current Journalism program work?
`
`It starts, as so many things do, with an upload: You submit a Pod through the CJ (Current
`Journalism) assignmentdeskfor consideration by Current's Vanguard Journalism team.
`You must read and accept the Current Journalism code of ethics as part of your upload
`Pm
`
`Then we'll take a look. If your Pod meets the standards and ethics requirements, we'll put It
`on our website where It will be eligible for community greenlighting and a shot at winning the
`weekly leaderboard competition, which may result In your plece getting on air. It may also
`catch the eye of someone on Current's Vanguard Journalism team. If your Pod is more of a
`rant or not really news-oriented, we'll just reassign It to a non-CJ Pod category.
`
`If your CJ Pod makes it to air, you become part of our extended CJ network. And your next
`uploaded submission will get direct consideration for review. You'll also be eligible to get

`
`You'd be surprised at how much work goes into getting a five-minute piece of video ready
`for air on TV! It takes time to contact the producer and obtain the original media and
`necessary releases so we can use It on air. Occasionally there may be changes we want to
`make to the Pod. We try to work with the producer to make these changes whenever
`possible, but sometimes we proceed on post production, especially if the subject matter is
`timely. Next we put the final touches on the Pod - these include tweaking the audio and
`adding graphics. If we can't clear the music chosen by the producer, we have to rescore the
`Pod with music from our library. The final step is having our legal department clear the Pod
`for air. Sometimes this can hold up a Pod if we don't have all the releases from the producer
`or there Is content that has to be changed or removed. We aim to make this process fast and
`painless -- and you'll be looped in every step of the way.

`Why do some VC? Pods say "commissioned by Current TV" and have no
`Pe Komya
`
`We occasionally come across stories we think should be told from a VC? perspective. We
`always try to go to any producer who has uploaded a Pod to our site first. If we can't find a
`Producer who has already uploaded, we will reach out to any contacts we have in the area
`where the story is happening to identify a producer to commission. The best way to become
`eligible for VC? commissions is to upload a Pod to the site. All commissioned pieces are
`negotiated on a per-Pod basis. Since these Pods air with the VC? label on the network, we
`felt they should be on the website, along with the producers who made them. We want the
`community to comment on these Pods as a way to get audience feedback.
