`RE: IPR2017-00870 thru -00879
`
`Counsel for Patent Owner and Petitioner would like to inform the Board that the parties have been working to find a
`resolution to these matters since the last conference call with the Board.  As a result, the parties have come to an
`agreement in principal to terminate the proceedings based on Patent Owner’s agreement to forgo any appeals
`stemming from the Federal Circuit decision involving the patents‐at‐issue.    While the parties work on finalizing the
`details, the parties both agree to forgo oral arguments for these cases so that the Board can take the oral arguments off
`their schedule.

`The parties will make themselves available for a call on June 4 at the Board’s convenience, should the Board still like to
`have a call with the parties in light of the above‐described events.

`Regards,

`Joseph Palys
`Counsel for Petitioner

`Counsel,
`
`The patents involved in the subject IPRs have all been found invalid in a Rule 36 Decision by the Federal Circuit, affirming
`the district court’s ruling that the claims do not recite patent eligible subject matter under 35 U.S.C. 101. In view of the
`circumstances, the parties are requested to confer and propose dates and times during the week of May 21, 2018 for a
`conference with the Board to discuss the status of the pending IPRs. The parties should be prepared to discuss
`termination of the IPRs.
