`
`l, Miloche Kottrnan. declare as follows:
`
`1.
`
`2.
`
`3.
`
`I have personal knowledge of the facts set forth herein, and if called to testify, I could
`and would competently testify to the same.
`I am Head of Cataloging and Archival Processing, for the University of Kansas (KU).
`My office is located in the Watson library, mailing address 1425 Jayhawk Blvd.
`Lawrence, KS 66045-7544.
`I have served as Head of Cataloging and Archival Processing since May 2013 and have
`worked at KU since 1983.
`
`6.
`
`4. As Head of Cataloging and Archival Processing, lam familiar with the standard
`cataloging and acquisition practices at KU with respect to books, periodicals, and other
`materials it receives.
`5. KU holds a copy ofPliysics of Thin Films, Plasma Sourcesfor Tliiii Film Deposition and
`Etching, Vol. 18, Maurice H. Francombe and John L. Vossen, eds., published by
`Academic Press, inc. in 1994. That work includes the public.ation “Design of High-
`Density Plasma Sources for Materials Processing,” by Michael A. Liberrnan and Richard
`A. Gottscho (“Pl7y5ic3 ofl"-liiiz Films, Vol. 18”).
`It is the standard practice of KU to check-in and catalog each volume of Physics of Thin
`Films", Plasma Sozircesfor Tliin Film Deposition and Etching within _a few weeks of the
`acquisition of the title, and it would typically be available for circulation to the public
`within a few weeks of being catalo-ged. Members of the general public can locate
`individual volumes ofPl1ySics of llriii Films, Plasma S0.'El]‘C€.S'f(_)I‘ Thin Film Deposition
`and Etclzing by searching the KU catalog, which includes keyword searching capability.
`It is the standard practice of KU to stamp the received date on one of the front pages of
`received materials during the check-in process. The stamp on the first page ofPlrysics of
`T7/sin Films, Vol. 18 indicates that the library received the publication on August 25,
`1994‘
`
`7.
`
`8.
`
`It is also common practice at KU to stamp books or publications that are borrowed with
`the date that they are due. The earliest stamp in Physics ofll1iiiFilms, Vol. 18 shows a
`return due date of September 14, 1994. Therefore, it is clear that the book was available
`to the public no later than that date.

`both under Section 1001 of Title 18 of the United States Code and may jeopardize the validity of
`the application or any patent issuing thereon.
